THE LONDON BOROUGH OF ENFIELD DEFINITIVE MAP AND STATEMENT OF PUBLIC RIGHTS OF WAY – ADDITION OF THE FOOTPATHS KNOWN AS MERRYHILLS WAY OVER LAND KNOWN AS VICARAGE FARM, HADLEY ROAD, ENFIELD

THE LONDON BOROUGH OF ENFIELD (MERRYHILLS WAY FOOTPATHS) (DEFINITIVE MAP AND STATEMENT) LEGAL EVENT MODIFICATION ORDER 2018

1. The above Order, made on 26th June 2018 under section 53(2)(b) of the Wildlife and Countryside Act 1981, modified the London Borough of Enfield Definitive Map and Statement of Pubic Rights of Way in consequence of the occurrence of an event specified in section 53(3)(a)(iii) of that Act, namely the coming into operation of a public path creation agreement whereby new rights of way have been created over land in the area to which the Map relates, being rights of way such that the land over which the rights subsist are public paths. The paths are described in the Schedule to this Notice.

2. There is no right of objection to the Order.

3. A copy of the Order and the Order Map may be seen free of charge upon request at the Civic Centre, Silver Street, Enfield, Middlesex, EN1 3XD during normal office hours on Mondays to Fridays inclusive, from 09:00 until 17:00 hours. Copies of the Order and Order Map may be obtained on request.

4. The Order came into force on 26th June 2018 but if any person aggrieved by the Order wishes to question its validity, or any provision contained in it, on the grounds that it is not within the powers of the Wildlife and Countryside Act 1981 or on the grounds that any requirement of that Act or of any Regulations made under that Act has not been complied with in relation to the Order, they may, under paragraph 12 of Schedule 15 to that Act, within 6 weeks from 11th July 2018, make an application to the High Court.

5. Under the Local Government (Access to Information) Act 1985, any letter you write to the Council in response to this Notice may, upon written request, be made available to the press and to the public, who may be entitled to take copies of it if they so wish.

SCHEDULE

1. A footpath starting from the east side of the path that extends northwards from Enfield Road between the Trent Equestrian Centre and South Lodge Farm at a point approximately 366 metres north of Enfield Road (Point A on the Order Map, OS grid 529758, 196770), extending on the north and east banks of Merryhills Brook for a distance of approximately 1,086 metres to the corner of a field (Point B on the Order Map, OS grid 530793, 196972), from where the path proceeds north-eastwards along the south-east side of that field and then turns northwards (a distance of approximately 128 metres) and proceeds through a kissing gate (Point C on the Order Map, OS grid 530858, 197064), crosses the access way that leads from Vicarage Farm and the rifle range to Enfield Road, proceeds through another kissing gate, along the north-eastern boundary of the rifle range, through another kissing gate, through a field in an easterly direction and then in a northerly direction along the western bank of Salmon’s Brook and over a footbridge (a distance of approximately 333 metres) (Point D on the Order Map, grid reference 530972, 197316). From here the path runs northwards for a distance of approximately 99 metres along the eastern bank of Salmon’s Brook to a point where there is a wooden post on each side of the path (Point E on the Order Map, grid reference 530917, 197398), it then proceeds north-eastwards along the south-eastern side of a field for a distance of approximately 134 metres to the corner of that field (Point F on the Order Map, grid reference 531027, 197462) from where it turns northwards along the eastern side of the field for a distance of approximately 94 metres ending at a kissing gate leading into the adjacent woodland (Point G on the Order Map, grid reference 530991, 197556). The footpath has a total length of approximately 1,874 metres and a width of 1 metre throughout.

2. A footpath starting from the northern end of Trentwood Side (Point H on the Order Map, OS grid 530709, 196936) and extending eastwards for a distance of approximately 78 metres to the western bank of Merryhills Brook (Point I on the Order Map, OS grid 530780, 196969), with a width of 1 metre throughout.

3. A footpath along the access way that leads from Vicarage Farm and a rifle range to Enfield Road, starting at the north-western boundary of Trentwood Side Allotments (Point J on the Order Map, OS grid 530903, 197023) and extending north-westwards for a distance of approximately 59 metres to kissing gates on either side of that access way (Point C on the Order Map, OS grid 530858, 197064), with a width of 1 metre throughout.
