EXPERIMENTAL INTRODUCTION OF: GREEN MAN (GM) (T36A(18)), CATHALL NORTH (CTN) AND CATHALL SOUTH (CTS) (T36BC(18)) AND MODIFICATION OF OLIVER ROAD (OL) CONTROLLED PARKING ZONES (CPZS) (ALL E11 STREETS (EXCEPT OL CPZ)

1. NOTICE IS HEREBY GIVEN that the London Borough of Waltham Forest (the Council) on 10th September 2018 made:

(a) The Waltham Forest (Charged-For Parking Places) (Amendment No. 124) Experimental Order 2018 and The Waltham Forest (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No. 157) Experimental Order 2018 [relating to GM CPZ];

(b) The Waltham Forest (Charged-For Parking Places) (Amendment No. 125) Experimental Order 2018 and The Waltham Forest (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No. 158) Experimental Order 2018 [relating to CTN CPZ];

(c) The Waltham Forest (Charged-For Parking Places) (Amendment No. 126) Experimental Order 2018 and The Waltham Forest (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No. 159) Experimental Order 2018 [relating to CTS CPZ];

(d) The Waltham Forest (Charged-For Parking Places) (Amendment No. 83) (Modification No. 2) Experimental Order 2018 and The Waltham Forest (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No. 113) (Modification No. 2) Experimental Order 2018 (OL CPZ);

under sections 9 and 10 of the Road Traffic Regulation Act 1984. The Orders referred to in sub-paragraph (a) will come into force on 24th September 2018; the Orders referred to in sub-paragraphs (b) and (c) will come into force on 1st October 2018; and each may continue for up to 18 months from the date the orders come into force. The Orders referred to in sub-paragraph (d) will come into force on 24th September 2018 and may continue in force until 5th September 2019

2. The general effect of the Orders referred to in paragraph 1(a) above will be, as an experiment, to:-

(a) provide a Controlled Parking Zone (CPZ) to be called Green Man (GM) which will include Ashbridge Road, St Andrew’s Road, Chadwick Road (CHD), Dyson Road (DY), Fladgate Road (FG), Forest Glade (FOR), Maple Road, Poppleton Road (PO), Preston Road (PRS), Teesdale Road, Whipps Cross Road (WHP) (between Forest Glade and Whipps Cross roundabout);

(b) introduce new permit holder parking places (in Whipps Cross Road (the southernmost arm (no-through-road section) will be indicated by the sign “Permit holders parking only past this point” with no specific parking places marked on the carriageway) and waiting restrictions into the streets and parts of streets mentioned in paragraph 2(a) above;

(c) introduce Free Short Stay parking places operating Mondays to Saturdays between 10 am to 4 pm into:

(i) Preston Road (northern side – outside No. 2a PRS), Poppleton Road (south side opposite Nos. 1/2a), St Andrew’s Road (northern side - adjacent to the Church), Whipps Cross Road, (northern side - opposite Nos. 129 to 141 WHP) (max stay 30 mins, no return for 2 hours); and

(ii) Chadwick Road (southern side – (x 2 bays) outside Nos. 17/19 and 29/31) (max stay 1 hour, no return for 2 hours)

(d) introduce formal disabled person’s parking places (for disabled blue badge holders only) into: Dyson Road (northern side – outside No. 7 DY); Preston Road (east side – outside flank wall of No. 67 PO); and Poppleton Road (western side (x 4 bays) – outside Nos. 11/13, 59/61, 89 and 97 PO);

3. The general effect of the Orders referred to in paragraph 1(b) above will be, as an experiment, to:-

(a) provide a CPZ to be called Cathall North (CTN) which will include Clover Close, Cowley Court, Gramer Close, Granleigh Road (GRN), Lascelles Close, Lincoln Street (LN), Lynn Road Marchant Road, Mayville Road (MY), Melford Road (MEL), Norman Road (NMN); Park Grove Road (PGV), Short Road (SH), Southwell Grove Road (SGV), Trinity Close, West Street (WT) and Woodlands Road;

(b) introduce new permit holder parking places (in Clover Close, Cowley Court, Lascelles Close, Norman Road (part) and West Street they will be indicated by the sign “Permit holders parking only past this point” with no specific parking places marked on the carriageway) and waiting and loading restrictions into the streets and parts of streets mentioned in paragraph 3(a) above;

(c) with regard to Pay by Phone (PbyP) (cashless) parking places:

(i) introduce into Marchant Road, (northern side – opposite the Queen Elizabeth Second Jubilee Centre), West Street (eastern side - adjacent the public house and western side – adjacent No. 481A HRL), Lynn Road (southern side – immediately north of the petrol station; and Trinity Close (north side - outside the southern flank wall of No. 633 HRL; and High Road Leytonstone (west side (6 parking places) – between Nos. 527 and 555; Nos. 577 and 589; Nos. 595 to 613; Nos. 615 to 619; Nos. 625 to 631; and Nos. 639 to 645

(ii) suspend times of operation of PbyP between Nos. 483 and 505 and replace with new times of operation mentioned in the note below;

(iii) High Road Leytonstone (west side (1 parking place) – between Nos. 567 and 575;

(d) introduce formal disabled person’s parking places (for disabled blue badge holders only) into: Granleigh Road (southern side – outside Nos. 57/59 GRN); Lincoln Street (northern side – outside No. 67 LN); Melford Road (southern side – outside No. 68 MEL); Park Grove Road (southern side outside Nos. 66 and flank wall of No. 12 and northern side outside Nos. 83 PGV); Short Road (northern side – outside Nos. 19/21 SH and No. 106 NM); West Street (northern side – outside No. 2 WT); and

4. The general effect of the Orders referred to in paragraph 1(c) above will be, as an experiment :-

(a) to provide a CPZ to be called Cathall South (CTS) which will include: Anglian Road, Apollo Place, Apple Road, Birch Grove (BHG), Cathall Road (CTL), Corn Way (CNW), Denmark Street, Melon Road (MLN), Pear Road, Peppermint Place (part) (PP), Orange Grove (OG);

(b) to introduce new permit holder parking areas in all roads mentioned in paragraph 4(a) above (except Cathall Road between Nos. 7 and 53 which will have specific permit holder parking places instead) which will be indicated by the sign “Permit holders parking only past this point” with no specific parking places marked on the carriageway. Waiting and loading restrictions will also be provided into the streets and parts of streets mentioned in paragraph 4(a) above;

(c)with regard to PbyP parking places:

(iv) introduce into Melon Road - (south side – opposite No. 52); Cathall Road - (north side – opposite the rear of Nos. 17 and 18 Lascelles Close); and Denmark Street (both sides – adjacent the south wall of the public house on LHR); and

(v) suspend outside Nos. 2 to 8 Cathall Road;

(d) introduce formal disabled person’s parking places (for disabled blue badge holders only) into: Anglian Road (outside Nos. 6 and 11); Apple Road (outside Nos. 5, 6 and 8); Birch Grove (both sides – outside Nos. 7, 44, 47, 96 BHG); Cathall Road (eastern side – outside Nos. 27 and 29 CTL); Corn Way (eastern side – outside No. 47 CNW); Melon Road (northern side – outside Nos. 16/18 MLN); Orange Grove (eastern side – outside No. 36 OG); Peppermint Place (outside Nos. 43 to 47 PP);

Nb/ all PbyP parking places mentioned in this notice will operate Mondays to Saturdays. between 8am to 1pm and 2pm to 6.30pm (except between Nos. 567 and 575 High Road Leytonstone, where the times of operation will be from 10am - 1pm and 2pm - 6:30pm); all will have the first 15 minutes parking ‘free’ or Pay by Phone with a maximum stay of 2 hours and no return within 2 hours. Charges are shown in Schedule 4 below.

All disabled person’s parking places mentioned in this notice will operate “at any time”

5. The general effect of the experimental modification Orders will be, in:

A. Ive Farm Lane E10 to provide double yellow line “at any time” waiting restrictions on all sides except on:

a) the south-east side

(i) opposite the rear of Nos. 3 to 15 Simonds Road provide permit parking area for OL permit holders only (existing CPZ times of operation will apply); and

(ii) single yellow line waiting restrictions opposite the rear of Nos. 19 to 25 Simonds Road (existing CPZ times of operation will apply)

b) the north and north-west sides – provide double yellow line “at any time” waiting restrictions except for a 12 metre permit parking place for OL permit holders only adjacent the rear of Nos. 152 Church Road

B. in Villiers Close E10 – remove a section of “at any time” waiting restriction and replace with OL permit parking space on the south side of the turning area

6. The Orders will provide that

(a) the operational hours for the permit parking places, “permit parking beyond this point” areas in:

(i) GM CPZ will be between 10 a.m. and 4 p.m. on Mondays to Fridays inclusive (including Free Short parking places) ; and

(ii) CTN and CTS CPZs will be between 8 a.m. and 6.30 p.m. on Mondays to Saturdays inclusive;

(b) virtual residents’ permits, business/charity permits (eligible for charities registered with the Charities Commission only), visitors’ permits, school parking permits, school staff term-time only permits, virtual and hard-copy residents’ foreign vehicle permits, essential user/carers permits and tradespersons’ permit, may be issued, on payment of the appropriate charge as specified in paragraph 8 below, to a person who is the keeper of a passenger vehicle (having 8 passenger seats or less), certain goods carrying vehicles and invalid carriages, (motor cycles and disabled persons will be able to park in permit parking places free of charge, without the need of a parking permit) providing that in the case of

(i) a virtual residents’ permit, they are a resident of a property eligible to purchase permits as listed in a Schedule to this Notice and their vehicle is UK registered to that address;

(ii) a foreign vehicles residents’ permit (hard-copy/virtual), they are a resident of a property eligible to purchase permits as listed in a Schedule to this Notice and their vehicle is registered outside of the UK;

(iii) a business/charity permit/business visitor’s permit, they have a business in a property eligible to purchase permits as listed in a Schedule to this Notice and that the permit is for a vehicle which is essential to the operation of that business/charity and is used in the purchase and sale of goods or services in connection with that business/charity;

(iv) an essential users/carers permit, they are a doctor or carer who has a surgery in or works in the London Borough of Waltham Forest, or employed by or contracted to the Council, or employed by or contracted to a health authority, or employed by the Metropolitan Police (including Police officers), or employed by the London Fire and Civil Defence Authority, or a company that services fire-fighting appliances and for whom the use of a vehicle is essential to the carrying out of their public service duties, or to any carer registered with the Council who is in receipt of a DWP Carers Allowance and who is providing care to a resident living in a CPZ in the London Borough of Waltham Forest (‘the borough’), regardless of whether or not that carer resides in the borough, in a street or part of a street specified in paragraph 2(a), 3(a) or 4(a) above;

The Council would, in addition, consider applications for a carers permit on a case by case basis from carers who are not in receipt of a DWP Carers Allowance but who provide care to a resident living in a CPZ in the borough. Medical documents would need to be provided to the Council by the resident receiving care to support such an application. In such a case the carers permit would be charged at the current resident parking permit charge rates - as detailed on the council’s website, see:- https://walthamforest.gov.uk/node/356 .

(v) a schools parking permit, they are a parent of a student enlisted at a school situated in or near a street or part of a street specified in paragraph 2(a), 3(a) or 4(a) above;

(vi) a school staff term-time only permit, they are a registered member of staff at a primary or secondary school situated in a street or part of a street specified in sub-paragraph 2(a) or 3(a) above, who has a bona fide reason to drive to that school;

(vii) a tradespersons permit, which may be applied for by CPZ residents on the behalf of tradespersons engaged in work at their home address in or near a street or part of a street specified in paragraph 2(a), 3(a) or 4(a) above;

(viii) a visitors’ permit, if they are a resident of No. 463 High Road, Leytonstone E11, or a street or part of a property eligible to purchase permits as listed in any Schedule to this Notice and that such visitors permit is to be used by a bona fide visitor to their home;

(b) vehicles displaying any valid permit displaying the letters:

(i) GM may use any of the permit parking places provided in the streets and parts of streets specified in paragraph 2(a) above;

(ii) CTN may use any of the permit parking places provided in the streets and parts of streets specified in paragraph 3(a) above;

(ii) CTS may use any of the permit parking places provided in the streets and parts of streets specified in paragraph 4(a) above;

(c) other than in the permit parking places, “permit parking beyond this point” areas, Free Short Stay parking places, disabled persons parking places and any other parking place:

(i) referred to in paragraph 2 and any associated sub paragraphs above waiting and loading by vehicles will be restricted to prevent obstructive parking either (1) ‘at any time’, at road junctions, certain drop kerbs and certain other lengths to prevent obstructive parking at all times; or (2) between 10 a.m. and 4 p.m. on Mondays to Fridays inclusive in all other parts of streets within the GM CPZ;

(iii) referred to in paragraphs 3 or 4 and any associated sub paragraphs above, waiting and loading by vehicles will be restricted to prevent obstructive parking either (1) ‘at any time’, at road junctions, certain drop kerbs and certain other lengths to prevent obstructive parking at all times; (2) between 8 a.m. and 6.30 p.m. on Mondays to Saturdays inclusive in all other parts of streets within the CTN and CTS CPZs (except on the west side of High Road Leytonstone between Nos. 567 to 575 which will operate between 7am and 10am throughout the week);

7. The properties specified in:

(a) Schedule 1 to this Notice will be eligible in respect of permits to park in the GM CPZ;

(b) Schedule 2 to this Notice will be eligible in respect of permits to park in the CTN CPZ; and

(c) Schedule 3 to this Notice will be eligible in respect of permits to park in the CTS CPZ

8. The charges for permits and vehicle class will be as follows:

Note: All Visitor Permits will be capped to a maximum of 8 hours on the number of 1 hour hard-copy visitor permits or 1 hour virtual visitor permits required to permit all-day visitor parking in any of the borough’s CPZs where the permitted hours are more than 8 hours in duration.

9. Where it appears necessary for certain purposes, an authorised officer of the Council may, in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, modify or suspend any provision of the experimental Traffic Orders while they are in force.

10. Documents giving more detailed particulars of the Orders are available for inspection between 9.30 am and 4.30 pm on Mondays to Fridays inclusive (except Bank Holidays), from 10th September 2018 until the Orders cease to have effect, at (a) The Information Desk, Town Hall, Forest Road, Walthamstow, E10; (b) Low Hall, Argall Avenue, London, E10 7AS.

11. The Council will be considering in due course whether the provisions of the experimental Orders should be continued in force indefinitely by means of permanent Orders made under sections 6, 45, 46 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984. Any person may object to the making of the permanent Orders for the purpose of such indefinite continuation within a period of six months beginning with the day on which the experimental Orders come into force or, if the Orders are varied by another Order or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into force. Any such objection must be made in writing and must state the grounds on which it is made and be sent specifically to the following address: Traffic Orders, Engineering Design, Low Hall, Argall Avenue, London, E10 7AS quoting:

(a) in respect of an Order referred to in paragraph 1(a) above, reference T36a(18) – GREEN MAN (GM) CPZ; or

(b) in respect of an Order referred to in paragraph 1(b) above, reference T36b(18) – CATHALL NORTH (CTN) CPZ;

(c) in respect of an Order referred to in paragraph 1(c) above, reference T36c(18) – CATHALL SOUTH (CTS) CPZ;

(c) in respect of an Order referred to in paragraph 1(d) above, reference T36d(18) – OLIVER ROAD (OL) CPZ MOD 2;

Any objection may be communicated to, or be seen by, other persons who may be affected.

12. If any person wishes to question the validity of any the Orders or of any of their provisions on the grounds that they are not within the powers conferred by the Road Traffic Regulation Act 1984, or that any requirement of that Act or any instrument made under that Act has not been complied with, that person may, within 6 weeks from the date on which the Orders are made, apply for the purpose to the High Court.
