THE TRANSPORT AND WORKS (APPLICATIONS AND OBJECTIONS PROCEDURE) (ENGLAND AND WALES) RULES 2006 – RULE 14(1)

PROPOSED WEAR VALLEY RAILWAY (TRANSFER) ORDER

NOTICE OF APPLICATION FOR AN ORDER

SWINMADCO 57 Limited (“the Applicant”) (company registration number 12392050) of Vinovium House, Saddler Street, Bishop Auckland, Co. Durham, DL14 7BH is applying to the Secretary of State for Transport under section 6 of the Transport and Works Act 1992 for an Order, under sections 1 and 5 of that Act.

The proposed Order, if made, makes provision for the transfer from Weardale Railways CIC (“the Transferor”) (company registration number 02823284) of Minerva, 29 East Parade, Leeds, Yorkshire LS1 5PS to the Applicant of certain statutory provisions and other rights and liabilities relating to the Wear Valley Railway in County Durham. The Order also makes related provisions.

It is the intention of the Applicant to imminently change its registered name to Weardale Railway Limited and the Transferor is in the process of changing its registered name to Weardale Realisations CIC.

The application is not to be made subject to an environmental impact assessment.

Due to Government guidance on the COVID-19 movement restrictions and in light of the public health risk, paper copies of the application and of all the other documents submitted with it are not available to view at deposit locations. These documents are available to view online through the Applicant’s website at www.aucklandproject.org/news/twao from 1 July 2020 until 12 August 2020. Copies of individual documents are also available on request.

Any objections to, or other representations about, the proposals in the application should be sent to the Secretary of State for Transport, c/o Transport Infrastructure Planning Unit, Department for Transport, Zone 1/18, Great Minster House, 33 Horseferry Road, London SW1P 4DR, (email transportinfrastructure@dft.gov.uk) on or before 12 August 2020.

An objection or other representation MUST (i) be received by the Secretary of State on or before 12 August 2020, (ii) be made in writing (whether sent by post or e-mail), (iii) state the grounds of the objection or other representation, (iv) indicate who is making the objection or other representation, and (v) give an address to which correspondence relating to the objection or other representation may be sent. (If you are sending your objection or other representation by e-mail, please provide a postal address and state “Wear Valley Railway (Transfer) Order” in the subject of the email.)

The Secretary of State may make complete copies of the objection and other representations public, including any personal information contained in them, and will copy them to the applicant for the Order.
