TRANSPORT AND WORKS ACT 1992

The Secretary of State for Transport gives notice under section 14(1)(b) and (2A) of the Transport and Works Act 1992 (“the Act”) that he has determined under section 13(1) of the Act to make with modifications the Midland Metro (Wednesbury to Brierley Hill Land Acquisition) Order 2020 (“the Order”).

The Order was applied for West Midlands Combined Authority (“WMCA”) of 16 Summer Lane, Birmingham, B19 3SD. It will renew the same powers of compulsory land acquisition as those that were previously conferred by the Midland Metro (Wednesbury to Brierley Hill and Miscellaneous Amendments) Order 2005 (“the 2005 order”). These include powers to take possession of land, or to acquire rights over land, either permanently or temporarily. The land acquisition powers conferred by the 2005 Order were limited by statute to a period of five years, and those powers powers expired in 2010.

The Secretary of State has, pursuant to section 14(1)(a) of the Act, given notice of his determination by way of a decision letter dated 26/06/2020, copies of which may be obtained from the Transport Infrasturcture Planning Unit, Department for Transport, Great Minster House, 33 Horseferry Road, London, SW1P 4DR. That letter gives the reasons for the determination and the considerations upon which it is based; information about the public participation process; and information regarding the right to challenge the validity of the determination and the procedures for doing so.
