NOTICE OF INTENTION TO APPLY TO STOP UP THE HIGHWAY KNOWN AS LITTLE SLADES, ROCKBEARE, DEVON
NOTICE is hereby given that Devon County Council as Highway Authority for the County of Devon intends to apply to Exeter Magistrates’ Court, Southernhay Gardens, Exeter, EX1 1UH on Thursday 21st January 2021 at 3pm for an Order under Section 116 of the Highways Act 1980 authorising the stopping up of an area of the highway known as Little Slades, Rockbeare, Devon as shown hatched in red on the plan on the ground that the said highway is unnecessary.
The effect of the Order will be to extinguish all public rights of way over the said land, save that any statutory undertaker whose apparatus is under, in, upon, along or across the highway the subject of this application will have the same powers and rights in respect of that apparatus as if the order authorising the highway to be stopped up or diverted had not been made or, as the case may be, as if the conveyance of land pursuant to Section 256 of the Act had not been made.
A copy of the draft Order and Plan may be inspected free of charge at County Hall, Topsham Road, Exeter by appointment between the hours of 10.00 a.m. and 4.00 p.m. Monday to Friday (excluding bank holidays and public holidays).
Any person to whom this Notice has been given may appear before the Magistrates’ Court to raise an objection or make representations on the application. Any person intending to appear before the Magistrates’ Court at the hearing of the application is requested to inform the County Solicitor not less than 7 days before the date of the hearing by telephoning 01392 382315 quoting reference MH/B17455.
