THE TRANSPORT AND WORKS (APPLICATIONS AND OBJECTIONS PROCEDURE) (ENGLAND AND WALES) RULES 2006 – RULE 14(1)

PROPOSED RIXTON AND WARBURTON BRIDGE ORDER

NOTICE OF APPLICATION FOR AN ORDER

The Manchester Ship Canal Company Limited (“MSCC”) (Company Registration Number 07438096) of Maritime Centre, Port of Liverpool, Liverpool, Merseyside, L21 1LA has applied to the Secretary of State for Transport under section 6 of the Transport and Works Act 1992 for the above-mentioned Order under section 3 of that Act.

The purpose of the draft Order is to update and modernise provisions of the existing legislation in respect of the Rixton and Warburton Bridge, in particular to revise the tolls which MSCC may charge for use of the Rixton and Warburton Bridge and supersedes the toll levels set out in the Rixton and Warburton Bridge Act 1863.

The draft Order also contains provisions for MSCC to make new byelaws in relation to the good management and use of the Rixton and Warburton Bridge in order to safeguard the navigation of the Manchester Ship Canal.

In addition the draft Order contains provisions for MSCC to transfer the Rixton and Warburton Bridge Undertaking to the Rixton and Warburton Bridge Company Limited (Company No. 13617881), should MSCC so resolve.

The application is not to be made subject to an environmental impact assessment.

Any objections to, or other representations about, the proposals in the application should be sent to the Secretary of State for Transport, c/o Transport Infrastructure Planning Unit, Department for Transport, 5th Floor, Great Minster House, 33 Horseferry Road, London SW1P 4DR, (email transportinfrastructure@dft.gov.uk) on or before Tuesday 18 January 2022.

An objection or other representation MUST (i) be received by the Secretary of State on or before Tuesday 18 January 2022, (ii) be made in writing (whether sent by post or e-mail), (iii) state the grounds of the objection or other representation, (iv) indicate who is making the objection or other representation, and (v) give an address to which correspondence relating to the objection or other representation may be sent. (If you are sending your objection or other representation by e-mail, please provide a postal address and state “Rixton and Warburton Bridge Order” in the subject of the email.)

The Secretary of State may make complete copies of the objection and other representations public, including any personal information contained in them, and will copy them to the applicant for the Order.
