The Secretary of State for Transport gives notice under section 14(1)(b), (2A) (3A) and (3AA) of the Transport and Works Act 1992 (“the Act”) that he has determined under section 13(1) of the Act to make with modifications the the Network Rail Huddersfield to Westtown (Dewsbury) Order 2022 (“the Order”).

The Order was applied for by Network Rail Infrastructure Limited (“the Applicant”) of 1 Eversholt Street, London NW1 2DN. The Order would confer powers on NR for the construction, operation and maintenance of works on the North Transpennine railway line between Huddersfield and Westtown (Dewsbury) for the purposes of increasing capacity and improving both journey times and the performance reliability of railway services on the route between Huddersfield and Westtown (Dewsbury) and between Manchester, Leeds and York. The Order would authorise Network Rail to acquire land, subsoil of land and interests in land, including the imposition of restrictive covenants, and to temporarily acquire and temporarily use land for the purposes of the works authorised by the Order. The Order would also confer powers in connection with the construction and operation of the railway. The Secretary of State has, pursuant to section 14(1)(a) of the Act, given notice of his determination by way of a decision letter dated 27 June 2022, copies of which may be obtained from the Transport Infrastructure Planning Unit, Department for Transport, Zone 1/14, Great Minster House, 33 Horseferry Road, London, SW1P 4DR by emailing transportinfrastructure@dft.gov.uk. That letter gives the reasons for the determination and the considerations upon which it is based; information about the public participation process; and information regarding the right to challenge the validity of the determination and the procedures for doing so.
