HIGHWAYS ACT 1980 – SECTION 291
NOTICE OF INTENDED ENTRY FOR PURPOSE OF MAINTENANCE OF STRUCTURES OR WORKS
To: The Owner/Occupier of Land adjacent to Pingle Woods, Bridge Lane, Low Ibbotsholme, Lakes, Troutbeck Bridge, South Lakeland (“the Land”)
Cumbria County Council (“the Council”), pursuant to Section 291 of the Highways Act 1980, hereby gives you notice that after 7 days from the date of service of this notice, the Council intends to enter onto the Land, for the purpose of: -
Carrying out the works of repair to 100m length of failing Masonry Retaining Wall and associated failing Slope above at Bridge Lane, Troutbeck Bridge. Works to comprise of Slope Stabilisation with a Soil Nailing and netting system, and associated rebuild of the Masonry Wall.
Where damage is caused to the Land or to any chattels on it, you may recover compensation in respect of that damage from the Council and, where your enjoyment of the Land or any chattels on it has been disturbed, you may recover compensation in respect of that disturbance.
If you obstruct an officer or authorised person acting in pursuance of Section 291 of the Highways Act 1980, or you remove or interfere with any apparatus placed or left on or in the Land, you will be guilty of an offence and liable to a fine not exceeding level 3 on the standard scale.
