SENSITIVE AREAS IN ENGLAND MADE UNDER THE URBAN WASTE WATER TREATMENT (ENGLAND AND WALES)

REGULATIONS 1994 (S.I. 1994 NO. 2841), URBAN WASTE TREATMENT (ENGLAND AND WALES) (AMENDMENT)

REGULATIONS 2003 (S.I. 2003 NO. 1788)

The above-mentioned 2003 Regulations require Defra to issue a Notice to the Environment Agency setting out the identification, modification and revocation of designated sensitive areas, (the water bodies detailed in the Notice Schedule).

The identification, modification and revocation of designated sensitive areas takes effect from 13 May 2023.

The 2003 Regulations further require the Notice to be published in the London Gazette and on Defra’s website.

Maps of the sensitive areas are available on the government website (www.gov.uk) in accordance with regulation 3(1) of the 2003 Regulations. In accordance with regulation 3(2) of the 2003 Regulations, the maps and information are available at the Environment Agency’s offices for inspection by the public.

URBAN WASTE WATER TREATMENT IDENTIFICATION OF SENSITIVE AREAS NOTICE 2023

The Secretary of State, in accordance with the duty in regulation 3(2) of the Urban Waste Water Treatment (England and Wales) Regulations 1994(1) (“the 1994 Regulations”) to review the identification of sensitive areas (as defined in regulation 3(1) of the 1994 Regulations) and, in accordance with regulation 2(1) of the Urban Waste Water Treatment (England and Wales) (Amendment) Regulations 2003(2), in relation to England gives notice to the Environment Agency as follows:

Citation and commencement

1. — This Notice may be cited as the Urban Waste Water Treatment Identification of Sensitive Areas Notice 2023.

1. This Notice takes effect on 13 May 2023.

Identification of sensitive areas

2.  Each area of water listed in the Schedule to this Notice is—

a. identified as a sensitive area where listed in Section A;

b. identified as a sensitive area with modifications where listed in Section B; or

c. no longer identified as a sensitive area where listed in Section C.

Effect of this notice

3.  This Notice does not affect any earlier identification of areas of water as sensitive areas save as set out in the Schedule to this Notice.
