THE CHESHIRE EAST COUNCIL (A533 MIDDLEWICH EASTERN BYPASS) (CLASSIFIED ROAD) (SIDE ROADS) ORDER 2022
THE SECRETARY OF STATE for Transport hereby gives notice that on 06 June 2023 he has confirmed, with modifications, the above-named Scheme and Order made by Cheshire East Council.
(1) The Scheme is made under section 106(3) of the Highways Act 1980 and, as confirmed, authorises the Council to construct over the navigable waters of the Trent and Mersey Canal the bridge specified in the Schedule to the Scheme as part of the highway they are proposing to construct from a point on the A533 Booth Lane 30 metres north east of the private access to No. 1 East Tetton Cottages, and opposite the private access to Pear Tree Cottage, eastwards to a new roundabout junction of the proposed A533 Middlewich Eastern Bypass, in the Parish of Moston and in the Town of Middlewich, in the Borough of Chester East, in the County Palatine of Cheshire.
(2) The Order is made under sections 8, 14 and 125 of the Highways Act 1980 and, as confirmed, authorises the Council to –
(a) improve highways;
(b) stop up highways;
(c) construct new highways;
(d) stop up private means of access to premises; and
(e) provide new means of access to premises,
all on or in the vicinity of the route of the A533 classified road which the Council propose to construct as the Middlewich Eastern Bypass, from a point on Pochin Way, at the eastern side of the private access road to Optima Logistics off Pochin Way, and extending south eastwards, then southwards, then south eastwards for 2.74 kilometres, to connect with the A533 just east of where it junctions with Moston Footpath 6, at a point some 140 metres south east of Tetton Bridge.

• Middlewich Library, 22 Lewin Street, Middlewich CW10 9AS between the hours of 9:30-17:00 Monday, Tuesday and Friday, 09:30-19:00 Thursday and from 9:30-13:00 on Saturday;
• Sandbach Library, The Commons, Sandbach CW11 1FJ between the hours of 9:00-17:00 Monday, Tuesday, Thursday and Friday, 09:00-19:00 Wednesday and from 9:00-13:00 on Saturday;
• Northwich Library, at its temporary location at Weaver Hall Museum and Workhouse, London Road, Northwich, CW9 8AB between the hours of 09:00-17:00 Monday, Tuesday and Wednesday, 09:00-19:00 Thursday and Friday and 09:00-13:00 on Saturday;

COPIES of the instrument of confirmation of the Scheme which is entitled “The Cheshire East Council (A533 Middlewich Eastern Bypass – Trent and Mersey Canal Bridge) Scheme 2022 Confirmation Instrument 2023” and which contains a copy of the relevant Scheme as confirmed, can be obtained at www.legislation.gov.uk or purchased either through booksellers or direct from Government bookshops (The Stationery Office (https://tsoshop.co.uk)).
ANY PERSON aggrieved by or desiring to question the validity of the Scheme or Order, or of any provision contained therein, on the grounds that it is not within the powers of the Highways Act 1980 or that any requirement or regulation made has not been complied with, may, within 6 weeks of 21 June 2023, apply to the High Court for the suspension or quashing of the Scheme or Order or of any provision included.
