PROPOSED NORTHAMPTON AND LAMPORT LIGHT RAILWAY (AMENDMENT) ORDER

NOTICE OF APPLICATION FOR AN ORDER

The Northampton Steam Railway Limited (“the Company”) of 30 Harborough Road, Kingsthorpe, Northampton, NN2 7AZ has applied to the Secretary of State for Transport under section 6 of the Transport and Works Act 1992 for the above-mentioned Order to be made under sections 1 and 5 of that Act.

The proposed Order, if made, would amend the Northampton and Lamport Light Railway Order 1995 (SI 1995/1300) (“the 1995 Order”) to authorise an extension of the operation and maintenance of the railway operated by the Company, and for related purposes.  The Company operates the railway under the authority of the 1995 Order, which authorised the Company to construct, maintain and operate a British Railways Board railway originally authorised by the London and North Western Railway (Northampton and Market Harborough &c. Branches) Act 1853, which had been abandoned.  Works to reinstate the railway were carried out under authority of two planning permissions granted in 1987 and 1990.  The Company has now reinstated a further section of railway of approximately 750m (under these planning permissions and an additional permission obtained in 2007) but needs authority to operate and maintain that additional section.  The proposed amendment Order would amend the description of the railway in the 1995 Order to cover that additional section.

The proposed Order would, by authorising the creation of a level crossing, permanently restrict the use of a public footpath (public right of way CC4) which crosses the additional section of railway.  In practice, use of the public footpath would be restricted only during such times as the level crossing gates were closed to allow the passage of trains.

The Secretary of State has determined that the application is not to be made subject to an environmental impact assessment.

Any objections to, or other representations about, the proposals in the Order application should be sent to the Secretary of State for Transport c/o Transport Infrastructure Planning Unit, Department for Transport, Great Minster House, 33 Horseferry Road, London SW1P 4DR (email: transportinfrastructure@dft.gov.uk).

An objection or representation MUST (i) be received by the Secretary of State for Transport on or before 29 September 2023, (ii) be made in writing (whether sent by post or e-mail), (iii) state the grounds of the objection or representation, (iv) indicate who is making the objection or representation, and (v) give an address to which correspondence relating to the objection or representation may be sent.  (If you are sending your objection or other representation by e-mail, please provide a postal address).

The Secretary of State for Transport may make complete copies of the objections or other representations public, including any personal information contained in them, and will copy them to the applicant for the Order.
