The Secretary of State for Transport gives notice under section 14(1)(b), (2A) of the Transport and Works Act 1992 (“the Act”) that the Secretary of State has determined under section 13(1) of the Act to make with modifications The Rixton and Warburton Bridge Order 2023 (“the Order”).

The Order was applied for by The Manchester Ship Canal Company Limited (“MSCC”) Maritime Centre, Port of Liverpool, Liverpool, Merseyside, L21 1LA. It will authorise a modernisation and update of the provisions within the existing legislation in respect of the Rixton and Warburton Bridge (“the undertaking”). In particular to revise the tolls the Applicant may charge for use of the undertaking; superseding the toll levels set out in section 48 of the Rixton and Warburton Bridge Act 1863. This would follow a period of improvement works to the undertaking, and the introduction of an automatic number plate recognition system, as set out in Schedule 8 to the Order. Additionally, the Order would allow the Applicant to make new byelaws for management of the undertaking and allow for the transfer of the undertaking to a new company, should the Applicant wish. The Secretary of State has, pursuant to section 14(1)(a) of the Act, given notice of his determination by way of a decision letter dated 6 October 2023, copies of which may be obtained from the Transport Infrastructure Planning Unit, by emailing transportinfrastructure@dft.gov.uk. That letter gives the reasons for the determination and the considerations upon which it is based; information about the public participation process; and information regarding the right to challenge the validity of the determination and the procedures for doing so.
