NOTICE OF INTENTION TO APPLY TO STOP UP THE HIGHWAY AT LAND ADJACENT TO 120-124 VALE AVENUE, BRIGHTON, BN1 8YF
NOTICE is given that BRIGHTON & HOVE CITY COUNCIL as Highway Authority intends to apply to BRIGHTON MAGISTRATES' COURT sitting at EDWARD STREET, BRIGHTON, BN2 0LG on 22 December at 2pm for an Order under Section 116 of the Highways Act 1980 authorising the stopping up of an area of the highway known as Land Adjacent to 120-124 Vale Avenue, Brighton, BN1 8YF (“the Highway”) on the ground that the Highway is unnecessary. The area of said Highway can the described as a strip of land measuring 72 square metres. The strip of land is 54 metres long, and of irregular width, between 1 and 1.5 metres across.
The effect of the Order will be to extinguish all public rights of way over the said Highway, save that any statutory undertaker whose apparatus is under, in, upon, along or across the Highway the subject of this application will have the same powers and rights in respect of that apparatus as if the Order authorising the Highway to be stopped up had not been made.
A copy of the draft Order and accompanying plan may be inspected free of charge at the Council Offices at TOWN HALL, NORTON RD, BRIGHTON AND HOVE, HOVE BN3 3BQ between the hours of 10:00 a.m. to 4:00 p.m. Monday to Fridays (excluding bank holidays and public holidays) from the date hereof.
Any person to whom this Notice has been given may appear before the Magistrates’ Court to raise an objection or make representations on the application. Any person intending to appear before the Magistrates' Court at the hearing of the application is requested to inform Brighton & Hove City Council c/o their instructed solicitors Sharpe Pritchard LLP (contact details: rlee@sharpeprichard.co.uk (R.Lee)) not less than 7 days before the date of the hearing by telephoning 020 7405 4600 quoting reference 000028/20.
