Notice is hereby given that, pursuant to a Block Transfer Order of Chief ICC Judge Briggs dated 26 February 2024 (amended by the Order of Chief ICC Judge Jones dated 14 March 2024 (the “Order”)), Richard Frank Simms (IP number 9252) (“the Applicant”) was removed as Office Holder in the cases listed in the schedules annexed to the Order (“the Schedules”) and Ian Michael Rose (IP number 9144) and Michelle Gillian Breslin (IP number 9579) (“the Replacement Office Holders”) both of F A Simms & Partners Limited of Alma Park, Woodway Lane, Claybrooke Parva, Lutterworth, Leicestershire LE17 5FB (registered office: Baird House Seebeck Place, Knowlhill, Milton Keynes, Buckinghamshire MK5 8FR) were appointed as Office Holders in his place as specified below. All removals and replacement appointments were made with immediate effect.

It has been ordered that:

1. Pursuant to Rule 12.37(1)(a) of the 2016 Rules, each of the County Court and Hearing Centre cases listed in the Schedules (“County Court Cases”) be transferred to the High Court of Justice, Business and Property Courts of England and Wales, Insolvency and Companies List (ChD) for the purpose only of making this order.

2. Immediately upon this order taking effect the County Court Cases be transferred back to the relevant County Court or Hearing Centre.

3. Richard Frank Simms (“Outgoing Office-holder”) be removed from office in respect of each of the cases listed in Schedules A, B, C, D, E and F (attached to this order) (“Block Transfer Cases”) from the date of this order. [The Schedules have been simplified in this notice to list the assignment and incoming office holders only].

4. Ian Michael Rose and Michelle Gillian Breslin be appointed as joint replacement office-holders in respect of each of the Block Transfer Cases, save for in respect of the matters set out in paragraphs 5 and 6 below, from the date of this order.

5. Michelle Gillian Breslin be appointed as joint office-holder in respect of the case of Maranatha Kitchens & Bathrooms Ltd listed in Schedule D, from the date of this order.

6. Ian Michael Rose be appointed as joint office-holder in respect of the cases of Environmental Control Coatings Ltd, LPH Concerts & Events Ltd and Foreman & Hill Ltd listed in Schedule D, from the date of this order.

7. Where the appointments referred to in this order are joint appointments, any act required or authorised under any enactment to be done by joint appointees may be done by all or any one or more of the persons at the time being holding office. No functions are required to be undertaken by both joint appointees acting together and no functions are specifically the responsibility of either joint appointee.

8. The creditors in each of the Block Transfer Cases be notified of this order by advertisement published in the London Gazette within 21 days of the date of this order.

9. Any creditor, or, in the case of any members' voluntary liquidation, any member, in respect of any of the companies or persons listed in Schedules A, B, C, D, E and F who has an objection to this order shall have 21 days from the date of advertisement in accordance with the preceding paragraph to apply to Court to set aside or vary the terms of the order. Such application shall not affect the transfer of the Block Transfer Cases until further or other order by the court.

10. The Applicants shall give notice to the Secretary of State and the Registrar of Companies of the Block Transfer Cases, as appropriate, and of the terms of this order as soon as reasonably practicable.

11. The Applicants shall file a copy of this order with each of the courts listed in the Schedules.

12. The Outgoing Office-holder shall receive his release as Liquidator, Trustee in Bankruptcy and Supervisor 21 days after the giving of notice to creditors in accordance with this order, save that such release may be subject to further order in the event of an application by any creditor or member under paragraph 9 of this order for the specific case subject to that application.

13. The Outgoing Office-holder shall receive his release as provided for under paragraph 12 of this order without being required to (i) apply to the Secretary of State for his release or discharge as appropriate or (ii) being required to file a receipts and payments account.

14. No Order as to costs.

15. This order having been made without a hearing any person other than the creditors described in the paragraph above may apply to set aside or vary this order within 7 days of service upon them.

16. The Respondents have the right to reply to Court to amend this order to include any appointments held which have been inadvertently omitted from the Application.
