NOTICE OF DETERMINATION
M27 JUNCTION 4 – 11 EMERGENCY AREA RETROFIT
ENVIRONMENTAL IMPACT ASSESSMENT
DETERMINATION UNDER SECTION 105AB (1)(B) OF THE HIGHWAYS ACT 1980 (AS AMENDED)
National Highways gives notice that it has been determined that the M27 Junction 4 – 11 Emergency Area Retrofit proposal which is a relevant project within the meaning of section 105ZA (2) of the Highways Act 1980 (as amended) is not subject to environmental impact assessment in accordance with Part 105A of the Highways Act 1980 (as amended).
This is due to the fact that there are no likely significant effects on the environment when taking into account the characteristics and location of the development, and the type and characteristics of the potential impacts.
This conclusion has taken into account measures to avoid or prevent significant adverse effects on the environment including the following:
• Design of the scheme to facilitate avoidance of the potential for significant environmental impacts.
• A separate Habitat Regulations Assessment screening report which concluded, after completing the screening stage of Habitat Regulations Assessment, that although the scheme is in proximity to or had potential linkage to one or more sites subject to the Habitats Regulations, that any potential for a Likely Significant Effect could be ruled out and that Appropriate Assessment is not required for this project.
• Construction using industry best practice methods which will be delivered via an Environmental Management Plan.
