LONDON BOROUGH OF BRENT

THE BRENT (PRESCRIBED ROUTES) (PEDESTRIAN & CYCLE ZONE) (NO. 1) EXPERIMENTAL TRAFFIC ORDER 2024

1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Brent on 12th September 2024 made the above-mentioned Order under sections 9 and 10 of the Road Traffic Regulation Act 1984, as amended by section 8 of and Part 1 of Schedule 5 to the Local Government Act 1985.

2. The general effect of the Order will be to merge the existing Kingsbury Green Primary School and St Robert Southwell RC Primary School Pedestrian and Cycle Zones (SZ 23 & SZ 31) and expand the merged zone, which currently only include a certain length of Old Kent Lane, a certain length of Slough Lane and the entire lengths of Sunningdale Gardens and Woodland Close so that:-

(a) both the existing Kingsbury Green Primary School and St Robert Southwell RC Primary School Pedestrian and Cycle Zones (SZ 23 & SZ 31) are merged into a single school street zone associated with permit number SZ 23 only; and

(b) the merged school street will prohibit any vehicle to enter the lengths of streets within the merged zone between 8.15 a.m. to 9.15 a.m. and 2.30 p.m. to 4.00 p.m. on Mondays to Fridays inclusive (term time only) and will now also include the following lengths of streets:-

(i) Old Kent Lane, between the north-western kerb-line of Sunningdale Gardens and the western kerb-line of Slough Lane; and

(ii) Slough Lane, between a point 12.00 metres north-east of a point opposite the common-boundary of Nos. 144 and 148 Slough Lane and the south-western kerb-line of Kingsbury Road.

3. The prohibition referred to in paragraph 2 above will not apply to:-

(a) a pedal cycle; or

(b) a valid SZ 23 permit; or

(c) any vehicle when used for fire brigade, ambulance or police purposes; or

(d) a valid blue badge holder residing in the above mentioned streets; or

(e) any person causing any goods vehicle to enter the above mentioned streets for the purpose of loading or unloading in the above mentioned streets; or

(f) any person causing any vehicle to enter the above mentioned streets for the purpose of gaining access to off-street garaging accessible only from the above mentioned streets; or

(g) any vehicle being used in connection with the maintenance, improvement, reconstruction, cleansing or lighting of the above mentioned streets or any street accessible only therefrom, or the laying, erection, alteration or repair of any sewer thereunder or of any main, pipe or apparatus for the supply of gas, water or electricity or of any electronic communications network thereunder or thereon, or the placing, maintenance or removal of any traffic sign thereon; or

(h) anything done with the permission or at the direction of a police constable in uniform; or

(i) any vehicle when used in the service of a local authority in pursuance of statutory powers or duties provided that in all the circumstances it is reasonably necessary in the exercise of such duties for that vehicle to enter and proceed in the roads referred to in paragraph 2 during the prescribed hours; or

(j) any resident residing in the above mentioned streets or a visitor visiting a resident in that street; or

(k) a carer assisting a resident residing in the above mentioned streets; or

(l) a hackney carriage; or

(m) any vehicle used for the purposes of school transport and taxi card transport services; or

(n) any vehicle when used for the purposes of transporting residents who reside in the above mentioned streets for medical appointments; or

(o) any vehicle when used for the purposes of Dial-a-Ride services to aid residents who reside in the above mentioned streets; or

(p) Royal Mail vehicles used for delivery purposes; or

(q) any vehicle used by a medical practitioner or healthcare worker to attend to a resident residing in the above mentioned streets; or

(r) any person who causes any vehicle to proceed in accordance with any restriction or requirement indicated by traffic signs placed pursuant to section 66 or 67 of the Road Traffic Regulation Act 1984.

4. A copy of the Order, which will come into force on 20th September 2024 and may remain in force for up to 18 months, of maps of the relevant areas (and of any related Order) can be inspected during normal office hours on Mondays to Fridays inclusive until the Order ceases to have effect, at Brent Customer Services, Brent Civic Centre, Engineers Way, Wembley, Middlesex, HA9 0FJ. Alternatively, those without internet access can receive a copy of the documents by post by phoning 0208 937 5230. A copy of the Order can also be obtained by emailing trafficorders@brent.gov.uk.

5. Any person desiring to question the validity of the Order or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Order may, within six weeks of the date on which the Order was made, make application for the purpose to the High Court.

6. Where it appears necessary for certain purposes, the Council's Head of Healthy Streets and Parking or any person authorised in that behalf by him may modify or suspend the order or any of its provisions, while the Order is in force.

7. The Council of the London Borough of Brent will consider in due course whether the provisions of the experimental Order should be continued in force indefinitely by means of an Order made under sections 6 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984. Any person may object to the making of the permanent Orders for the purpose of such indefinite continuation, within a period of six months beginning with the date on which the experimental Order comes into force or, if the Order is varied by another Order or modified pursuant to section 10(2) of the 1984 Act, beginning with the date on which the variation or modification or the latest variation or modification comes into force. Any such objection must be made in writing and must state the grounds on which it is made and be sent to Head of Healthy Streets and Parking, Healthy Streets and Parking Service, 6th Floor West Wing, Brent Civic Centre, Engineers Way, Wembley, Middlesex, HA9 0FJ or by email to trafficorders@brent.gov.uk, quoting reference TO/30/043/NP.
