NOTICE OF INTENTION TO APPLY FOR AN ORDER AUTHORISING
THE STOPPING UP OF A HIGHWAY PART OF CARRIAGEWAY AT CHURCH ROAD, TILSTON
NOTICE is hereby given that Cheshire West and Chester Borough Council, being the highway authority for the area, intend to apply to the Magistrates’ Court sitting at Chester on Wednesday 26 February 2025 at 10:00am for an Order under Section 116 of the Highways Act 1980 for stopping up an area of Church Road measuring approximately 68.6 square metres, which is adjacent to the property named ‘The Cape,’ Church Road, Tilston, Malpas SY14 7HB. The Order is made on the ground that the said part of Church Road is unnecessary as a highway.
The effect of the Order sought will be to extinguish the highway rights along the said part of Church Road.
At the hearing of the application any person who uses the highway and any other person who would be aggrieved by the making of the said Order shall have a right to be heard. A plan showing the extent of highway concerned may be inspected free of charge during normal office hours at Cheshire West and Chester Borough Council, The Portal, Wellington Road, Ellesmere Port, CH65 0BA.
