Notice is hereby given that, pursuant to a Block Transfer Order of ICC Judge Barber dated 2 January 2025 upon the application of Paul Mallatratt (IP number 20630), Stella Davis (IP number 9585), Paul Michael Davis (IP number 7805), Emma Mifsud (IP number 21070), Colin David Wilson (IP number 9478), Lisa Marie Ion (IP number 21912), Gareth David Wilcox (IP number 21052) and Paul William Harding (IP number 6310) (the “Applicants”), Paul Mallatratt was removed as Office Holder in the cases listed in the schedules annexed to the Order (the “Schedules”) and Stella Davis, Emma Mifsud, Paul Michael Davis, Colin David Wilson, Lisa Marie Ion, Gareth David Wilcox and Paul William Harding all of Opus Restructuring LLP (registered office: 2 Manor Farm Court Old Wolverton Road, Old Wolverton, Milton Keynes, Buckinghamshire, England, MK12 5NN) were appointed as Office Holders in his place as specified below. All removals and replacement appointments were made with immediate effect.

It has been ordered that:

1. Pursuant to Rule 12.37(1)(a) and (b) of the Insolvency (England and Wales) Rules 2016 (“IR 2016”), the cases set out in the Schedules, in so far as necessary, be transferred to the High Court of Justice from the Worcester County Court, Luton County Court, Milton Keynes County Court, Bristol County Court, Brighton County Court, Birmingham County Court, Southampton County Court, Sheffield County Court, Central London County Court, Huddersfield County Court, Canterbury County Court, Bournemouth and Poole County Court, Manchester County Court, Medway County Court, Stoke on Trent County Court, Walsall County Court, Oxford County Court, Newport (Gwent) County Court, Slough County Court, Reading County Court, Preston County Court, Southend County Court, Coventry County Court, Swindon County Court, Chester County Court and the Manchester, Birmingham and Leeds District Registries, for the purpose only of considering and making this Order and shall be treated as transferred back without any intervening administrative action forthwith upon the making of this Order.

2. Pursuant to Rule 12.37(1)(c) of the IR 2016, Paul Mallatratt (“Outgoing Office Holder”) be removed from office in respect of each of the cases listed in the Schedules (attached to this Order) (“Block Transfer Cases”) from the date of this Order. [The Schedules having been simplified in this notice to list the assignment, the incoming officeholder and ongoing officeholder only].

3. Pursuant to Rule 12.37(1)(d) of the IR 2016, Stella Davis, Paul Michael Davis, Emma Mifsud, Colin David Wilson, Lisa Marie Ion, Gareth David Wilcox and Paul William Harding be appointed as joint replacement office holders respectively in accordance with the Schedules, save for in respect of the cases set out in paragraphs 4 and 5 below, from the date of this Order.

4. Pursuant to Rule 12.37(1)(d) of the IR 2016, Stella Davis be appointed as sole replacement office holder in the matters of Anthony Matthews and Simon Peter Tarbard in accordance with Schedule A from the date of this Order.

5. Pursuant to Rule 12.37(1)(d) of the IR 2016, Gareth David Wilcox be appointed as sole replacement office holder in the matter of Jeremy Leigh Kleimunt in accordance with Schedule E from the date of this Order.

6. Where the appointments referred to in this Order are joint appointments, any act required or authorised under any enactment to be done by joint appointees may be done by all or any one or more of the persons at the time being holding office. No functions are required to be undertaken by both joint appointees acting together and no functions are specifically the responsibility of either joint appointee.

7. The creditors in each of the Block Transfer Cases be notified of this Order solely by advertisement published in the London Gazette within 21 days of the date of this Order.

8. Any creditor in respect of any of the companies or persons listed in the Schedules who has an objection to this order shall have 21 days from the date of advertisement in accordance with the preceding paragraph to apply to Court to set aside or vary the terms of this Order. Such Application shall not affect the transfer of the Block Transfer Cases until further Order or other Order by the Court.

9. The Applicants shall give notice to the Secretary of State and the Registrar of Companies of the Block Transfer Cases, as appropriate, and of the terms of this Order as soon as reasonably practicable.

10. The Applicants shall file a copy of this Order with each of the Courts listed in Schedules A, B, C, E and F.

11. The time by which progress reports are required to be delivered by an office holder shall be unaffected by the change in office holder.

12. The Outgoing Office Holder shall receive his release as Trustee, Liquidator, Supervisor and Administrator 21 days after the giving of notice to creditors in accordance with this Order, save that such release may be subject to further Order in the event of an application by any creditor under paragraph 8 of this Order for the specific case subject to that application.

13. The Outgoing Office Holder shall receive his release as provided under paragraph 12 of this Order without being required to (1) apply to the Secretary of State for his release or discharge as appropriate or (2) file a receipt and payments account.

14. The costs of and occasioned by this application insofar as they relate to the administrations set out in Schedule F be paid as an expense of the respective administration.

15. The costs of and occasioned by this application insofar as they relate to the bankruptcies set out in Schedule A, compulsory liquidations set out in Schedule B, company voluntary arrangements in Schedule C, creditors’ voluntary liquidations set out in Schedule D and individual voluntary arrangements in Schedule E shall be paid by Opus Restructuring LLP.

16. This Order having been made without a hearing any person other than the creditors described in paragraph 8 above may apply to set aside or vary this order within 7 days of service upon them.

17. The Respondents have the right to apply to Court to amend this Order to include any appointments held which have been inadvertently omitted from the Application.
