The Farm Sustainability Payments to Farmers (Amendment) Regulations (Northern Ireland) 2025 (SR 2025 No. 26) comes into operation on 10th March 2025 and is subject to the negative resolution procedure. The rule was made under powers conferred by sections 48 and 50(3)(a) of, and paragraph 5 of Schedule 6 to, the Agriculture Act 2020.

The Rule amends:

• Commission Delegated Regulation (EU) No. 640/2014 supplementing Regulation (EU) No. 1306/2013 of the European Parliament and of the Council with regard to the integrated administration and control system and conditions for refusal or withdrawal of payments and administrative penalties applicable to direct payments, rural development support and cross compliance to remove the methodology as prescribed by the EU in relation to the annual assessment of DAERA’s Land Parcel Identification System (LPIS), enabling a more meaningful methodology to be adopted to reflect the delivery of new schemes;

• The Common Agricultural Policy Direct Payments and Support Schemes (Cross Compliance) Regulations (Northern Ireland) 2014 and The Common Agricultural Policy Direct Payments and Support Schemes (Cross Compliance) (Amendment) Regulations (Northern Ireland) 2015 to reflect that DAERA is the Competent Control Authority responsible for cross compliance controls from 2025, and

• The Common Agricultural Policy Basic Payment and Support Schemes Regulations (Northern Ireland) 2015 to extend the closing date for the transfer of payment entitlements from 2nd May to 15th May from the 2025 scheme year.
