Insolvency (Northern Ireland) Order 2002, S.I. 2002/3152 (N.I. 6)
Notice is hereby given that in exercise of the power conferred on Her by paragraph 1(1) of the Schedule to the Northern Ireland Act 2000 (c.1) Her Majesty has made the Insolvency (Northern Ireland) Order 2002.
The Order makes provision:
| For small companies attempting to enter a voluntary arrangement to have the option of a short moratorium protecting them from proceedings by creditors |
| For Interim Orders in individual voluntary arrangements to become optional |
| For a new system for authorising nominees and supervisors to act in voluntary arrangements |
| For reports alleging criminal offences in company liquidations to be sent directly to the Director of Public Prosecutions |
| Allowing trustees administering deceased insolvencies to claim the value of the deceased’s interest in any property owned under a joint tenancy |
| Enabling the making of regulations to give effect to UNCITRAL model law on cross-border insolvency |
