The Mental Health (Amendment) (Northern Ireland) Order 2004

The Mental Health (Amendment) (Northern Ireland) Order 2004 has been approved by both Houses of Parliament. The Order places the burden of proof on the Health and Social Services Trust that a person, held under the provisions of the Mental Health (Northern Ireland) Order 1986, should continue to be detained. The burden of proof under the 1986 Order placed the burden of proof on the patient to show that they should be discharged.
