NOTICE OF SEIZURE UNDER THE CUSTOMS AND EXCISE MANAGEMENT ACT 1979
To: The owner of the following goods seized on 14 November 2012 at a shed adjacent to 18 Blackrock Road, Crossmaglen, Newry BT35 9AS
1x Iveco Panel Van Registration XIL9591
1x Fuel Pump
1x 2000 litre steel tank
650 litres of hydrocarbon oil.
Pursuant to Section 139(6) of the Customs and Excise Management Act 1979, and paragraph 1 of Schedule 3 thereto, the Commissioners hereby give notice that by virtue of the powers contained in the customs and excise Acts, certain goods namely, the aforesaid Vehicle was found on 14 November 2012 at a shed adjacent to 18 Blackrock Road, Crossmaglen, Newry BT35 9AS is hereby and by force of Section 88 of the Customs and Excise Management Act 1979, the aforesaid vehicle is liable to forfeiture.
The fuel pump and steel tank found with the aforesaid vehicle which was liable to forfeiture are also liable to forfeiture whereby and by force of Section 141 (1) (b) of the Customs and Excise Management Act 1979.
The 650 litres of hydrocarbon oil found with vehicle is liable to forfeiture whereby the force of Section 24 of the Hydrocarbon Oil Duties Act 1979.
If you claim that the goods were not liable to forfeiture you must within one month from the date of this notice of seizure give notice of your claim in writing in accordance with paragraphs 3 and 4 of the Schedule 3 to the Customs and Excise Management Act 1979.
If you live outside the United Kingdom or the Isle of Man you must also give the name and address of a solicitor within the United Kingdom who is authorised to accept service of the process on your behalf.
If you do not give notice of claim within the said period of one month or, if any requirement of the above mentioned paragraph 4 is not complied with, the goods will be deemed to have been duly condemned as forfeit.
If you do give notice of claim in the proper form, the Commissioners will take legal proceedings for the condemnation of the said goods.
