Notice of Application in terms of Section 75 of the Local Government (Scotland) Act 1973

An application has been lodged by Dundee City Council to the Court of Session seeking authority of the Court to dispone of ALL and WHOLE that plot or area of ground extending to fifteen hectares and seven decimal or one tenth parts of an hectare or thereby Metric Measure lying generally to the north of Kingsway and to the west of Old Glamis Road in the City of Dundee and County of Angus and bounded as follows: on or towards the west by the westmost face of a post and wire fence along which it extends one hundred and thirty two metres or thereby; on or towards the north by other subjects forming Number Sixty One Old Glamis Road along which it extends twenty seven metres or thereby; on or towards the west by the said subjects forming Number Sixty one and by adjoining subjects forming Number Sixty three Old Glamis Road, Dundee along which it extends thirty metres or thereby; on or towards the south by the said subjects forming Number Sixty three Old Glamis Road along which it extends twenty seven metres or thereby; again on or towards the west by the westmost face of a post and wire fence along which it extends two hundred and forty nine metres or thereby; on or towards the northwest by the northwestmost face of a post and wire fence along which it extends fourteen metres or thereby; on or towards the north by other Subjects belonging to Dundee City Council, along which it extends by the south most bank of the Gully Burn two hundred and seventy metres or thereby (Which boundary for the avoidance of doubt wholly excludes the said Gully Burn); on or towards the northeast by other subjects belonging to Dundee City Council along which it extends by an undefined boundary, following the curve, two hundred and thirty four metres or thereby; on or towards the east by other subjects belonging to Dundee City Council along which it extends following the western edge of the footpath two hundred and forty metres or thereby; on or towards the south by the southmost face of a hedge separating the subjects herein described from the northmost verge of the Kingsway along which it extends four hundred and thirty three metres or thereby and on or towards the southwest by the southeastmost face of a concrete embankment and wall along which it extends nine metres or thereby. The said property is situated in land disponed to the Lord Provost, Magistrates and Councillors of the City and Royal Burgh of Dundee by David Charles Erskine Erskine. Esquire of Linlathen, and to be held for the common good of the citizens of Dundee. Should any person having an interest in opposing the application wish to do so, they should contact the undernoted office, to be provided with a copy of the Petition, within 21 days of this notice.
