TOWN AND COUNTRY PLANNING (SCOTLAND) ACT 1997
THE PERTH AND KINROSS COUNCIL (PARTS OF CASTLE GABLE, PERTH) (STOPPING UP) ORDER 2002
Notice is hereby given that Perth and Kinross Council have on 20th January 2003 in exercise of the powers conferred on them by Schedule 16 to the Town and Country Planning (Scotland) Act 1997 and of all other powers enabling them in that behalf confirmed without modification The Perth and Kinross Council (Parts of Castle Gable, Perth) (Stopping Up) Order 2002 - the effect of which is to stop-up sections of road and footway at Castle Gable, Perth.
A copy of the Order as confirmed and relative plan specifying the sections of road to be stopped up may be inspected at the offices of Perth and Kinross Council, Council Building, 2 High Street, Perth (main reception) by any person free of charge from 8.45am to 5.00pm Monday to Friday for a period of 6 weeks from 14th February 2003.
The Order as confirmed comes into operation on 3rd March 2003 but a person aggrieved by the Order may in accordance with the provisions of Section 239 of the Town and Country Planning (Scotland) Act 1997, by application to the Court of Session within 6 weeks from 14th February 2003 being the date on which this Notice is first published question its validity on the ground that it is not within the powers conferred by the Town and Country Planning (Scotland) Act 1997, or that his interests have been substantially prejudiced by a failure to comply with any requirement of the said Act or of any regulations made thereunder.
