NOTICE UNDER SECTION 26(5) OF THE WILDLIFE AND COUNTRYSIDE ACT 1981
THE WILDLIFE AND COUNTRYSIDE ACT 1981 (VARIATION OF SCHEDULE) (SCOTLAND) ORDER 2005
Notice is hereby given under section 26(5) of the Wildlife and Countryside Act 1981 (“the 1981 Act”) that the Scottish Ministers, in exercise of the powers conferred on them by section 22(1)(c) of the 1981 Act, have made an Order to vary Schedule 9 to that Act.
The Order (“The Wildlife and Countryside Act 1981 (Variation of Schedule) (Scotland) Order 2005”) adds the under noted species of plant to Part II of Schedule 9 to the 1981 Act. The Order therefore has the effect of making it an offence, by virtue of section 14(2) of the 1981 Act, for any person to plant or otherwise cause to grow in the wild any plant of the species listed below, or any hybrid of such a plant.

The Order comes into force on 30 June 2005. The Order will be published by Her Majesty’s Stationery Office and will be available on the website of the Office of Public Sector Information (http://www.opsi.gov.uk/).
