TRANSPORT ACT 1968
THE BRITISH WATERWAYS BOARD (FORTH AND CLYDE AND UNION CANALS) (RECLASSIFICATION) ORDER 2011
In accordance with paragraph 5(1) of Schedule 13 to the Transport Act 1968 the SCOTTISH MINISTERS hereby give notice that they propose to make an Order under section 104(3) of that Act adding the Union Canal, including the Falkirk Wheel, and the Forth & Clyde Canal, including the navigable section of the Glasgow Arm, to Part II of Schedule 12 to the Act so that the main navigable channel of these canals shall be cruising waterways for the purposes of section 104(1)(b) of the Act.
IF THE ORDER IS MADE it shall be the statutory duty of The British Waterways Board under section 105 of the Act to maintain the length of the Union Canal, including the Falkirk Wheel, and the Forth & Clyde Canal, including the navigable section of the Glasgow Arm, for use by cruising craft, that is to say vessels constructed or adapted for the carriage of passengers and driven by mechanical power which are suitable for use on these canals which were built or restored as part of the Millennium Link project.
It should be noted that, pursuant to existing obligations with third parties, The British Waterways Board is already maintaining the length of these canals to cruising waterway standard. However, reclassification will safeguard the length of the Union Canal, including the Falkirk Wheel, and the Forth & Clyde Canal, including the navigable section of the Glasgow Arm, to through navigation for cruising craft for the long-term future.
ANY PERSON MAY OBJECT to the making of the proposed order within the period of 56 days commencing on 15 November 2010 (closing noon 10 January 2011) by notice to the Scottish Ministers quoting “the Union and Forth & Clyde canals”, addressed to c/o The Freight and Inland Waterways Branch, Transport Scotland, Area 2 G (Dockside), Victoria Quay, Edinburgh EH6 6QQ, or by e-mail to: scotlandscanals@scotland.gsi.gov.uk In preparing an objection it should be borne in mind that the substance of it may be imparted to other persons who may be affected by it and that those persons may wish to communicate to the objector about it.
