THE WILDLIFE AND COUNTRYSIDE ACT 1981 (VARIATION OF SCHEDULES A1 AND 1A (SCOTLAND) ORDER 2013

Notice is hereby given under section 26(5)(b) of the Wildlife and Countryside Act 1981 (“the 1981 Act”) that the Scottish Ministers, in exercise of the powers conferred on them by section 22(1)(a) of the Wildlife and Countryside Act 1981 and all powers enabling them to do so, have made the following Order: The Wildlife and Countryside Act (Variation of Schedules A1 and 1A) (Scotland) Order 2013.

The Order (The Wildlife and Countryside Act 1981 (Variation of Schedules A1 and 1A) (Scotland) Order 2013)) adds the following species to Schedules A1 and 1A, which relates to the protection of nests and nest sites, and protects birds from harassment:

Variation of Schedule A1

In Schedule A1 to the Wildlife and Countryside Act 1981 (protected nests and nest sites: birds), the following entry is inserted as the first entry—

Eagle, Golden Aquila chrysaetos

Variation of Schedule 1A

In Schedule 1A to the Wildlife and Countryside Act 1981 (birds which are protected from harassment), each of the following entries is inserted at the appropriate alphabetical place—

Harrier, Hen Circus cyaneus
Kite, Red Milvus milvus

The Order comes into force on 16 March 2013. The Order will be published by Her Majesty’s Stationery Office and will be available on the website of the Office of Public Sector Information (http://www.opsi.gov.uk ).
