The Stopping-up of Highways (Unnamed Highway, Strinds Quarry, Dolyhir, Powys) Order 1997

The Secretary of State for Wales hereby gives notice that he has made an Order under section 247 of the Town and Country Planning Act 1990, to authorise the stopping-up of the lengths of highway described in Schedule 1 to this notice.   The stopping-up is authorised only in order to enable the development described in Schedule 2 to this notice to be carried out in accordance with planning permission granted by Powys County Council on 23rd October 1991, under reference R4313. The Order shall cease to have effect on cessation of these planning permissions.   The Order requires the provision of new highway which will be highway maintainable at the public expense, for which Powys County Council shall be the Highway Authority.   Copies of the Order and the deposited plan may be inspected, free of charge, during normal office hours at the offices of Powys County Council, County Hall, Llandrindod Wells, Powys or Walton Parish Hall, Walton, Powys, between 8.45 a.m. and 12.45 p.m., on Fridays, or may be obtained, free of charge, from the Welsh Office Highways Directorate, Cathays Park, Cardiff CF1 3NQ, (quoting reference ZC 510-5-6-6).   If any person desires to question the validity of the Order, or of any provision contained therein on the grounds:   (a) that it is not within the powers of the Town and Country Planning Act 1990 or;   (b) that his interests have been substantially prejudiced by a failure to comply with any of the requirements of the Act, he may, within 6 weeks of 2nd January 1998, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.   The highways to be stopped up and provided under the Order are at Strinds Quarry, Dolyhir, in the county of Powys. They are shown by zebra hatching and stipple marking respectively on the deposited plan and comprises:

Descriptions of the lengths of highway to be stopped up under the Order

  That length of the C1345 road which extends from its junction with the C1341 road for a distance of 1,081 metres in a general south-westerly direction.

Description of the lengths of new highway to be provided under the Order

  A carriageway, 5 metres in width, extending from the C1345 road at the south-westerlymost end of the length of carriageway to be stopped up in a south-easterly direction for a distance of 270 metres to join the UC1065 road.
