CHELTENHAM BOROUGH COUNCIL
The Borough of Cheltenham (Graham Place/Falkland Place) (Prohibition of Driving) Order 1998

Notice is hereby given that on 13th January 1998, Cheltenham Borough Council in accordance with arrangements made under section 101 of the Local Government Act 1972, with Gloucestershire County Council the highway authority and in pursuance of the powers of the said County Council under sections 1, 2 and 4 of the Road Traffic Regulation Act 1984, (which said Act of 1984 is hereinafter referred to as “the Act”) and in exercise of all other powers it enabling in that behalf and after consultation with the Chief Officer of Police in accordance with paragraph 20 of Part III of Schedule 9 of the Act, made the above-named Order the effect of which will be to prohibit all vehicles other than pedal cycles from proceeding in:   (a) That length of Falkland Place which extends from its junction with the extended eastern kerb-line of Graham Place, for a distance of 5 metres in an easterly direction.   (b) That length of Graham Place which extends from its junction with the extended eastern kerb-line of Stanley Place, for a distance of 10 metres in an easterly direction.   The Order will come into effect on 22nd January 1998.   The Order gives permanent effect to the provisions of The Borough of Cheltenham (Stanley Place/Graham Place/Falkland Place) Experimental Traffic Order 1996, the effect of which was described in the Notice of making of that Order which appeared in Issue Number 54471 of The London Gazette published on 19th July 1996 (Reference 753).   The Order and a copy of the relevant map may be examined at the under-mentioned address on Mondays to Fridays between 9 a.m. and 5 p.m. Any person wishing to question the validity of the Order or any provision contained in it on the ground that it is not within the powers conferred by the Act of 1984, or on the ground that any requirement of the Act of 1984, or any Instrument made thereunder has not been complied with in relation to the Order, may within 6 weeks from 13th January 1998, make application to the High Court.
