The stopping-up and diversion of highways (highways near Betjeman Avenue, Longfellow Road and Masefield Road, Caldicot, Monmouthshire) Order 1986.
The Secretary of State for Wales hereby gives notice that he has made an Order under section 247 of the Town and Country Planning Act 1990 to authorise the stopping-up and diversion of the highways described in Schedule 1 to this notice.
  The stopping-up and diversion is authorised only in order to enable the development described in Schedule 2 to this notice to be carried out in accordance with planning permission granted by Monmouthshire Borough Council on 4th October 1994 under Ref. A37852. The Order shall cease to have effect upon the cessation of the planning permission.
  The Order requires the provision of new highway which will be highway maintainable at public expense, for which Monmouthshire County Council shall be the Highway Authority.
  Copies of the Order and the deposited plan may be inspected, free of charge, during normal office hours, at the offices of Monmouthshire County Council, Caldicot Area Housing Office, Woodstock Way, Caldicot, or may be obtained, free of charge, from the Welsh Office, Highways Directorate, Road Administration Division 3, Cathays Park, Cardiff CF1 3NQ (quoting Ref. ZC 510-5-33-1).
  If any person desires to question the validity of the Order, or any provisions contained therein, on the grounds:

  (a) that it is not within the powers of the Town and Country Planning Act 1990; or
  (b) that his interests have been substantially prejudiced by a failure to comply with any of the requirements of that Act,

he may, within 6 weeks of 23rd January 1998, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

Description of the highways to be stopped up under this Order

  The highways to be stopped up are located at Caldicot in the County of Monmouthshire. They are shown by zebra hatching on the deposited plan and compromise:

  (i) a rectangular shaped area of highway land, 8 metres in width, which extends for a distance of 15 miles from the turning head of the south-eastern boundary of Betjeman Avenue;
  (ii) a length of footpath east of the flats numbered 43-53 and 55-65 Longfellow Road, which extends from a point 11 metres south of its junction with the footway of Longfellow Road in a southerly direction for a distance of 30 metres; and
  (iii) the length of footpath which extends from its junction with the western footway of Masefield Road, east of the gable end of the property known as No. 1 Byron Place, in a general westerly direction for a distance of 25 metres.

Description of the new highway to be provided under this Order

  The highway to be provided is shown by stipple marking on the deposited plan and will form the diversion for the length of footpath to be stopped up and described at (ii) above. It comprises a new length of footpath which extends from its junction with the existing footpath, 11 metres south of the junction of the existing footpath with the footway of Longfellow Road, in a general southerly direction for a distance of 32 metres.

  The relocation of car parking facilities and erection of dwellings together with associated access roads, car parking facilities and footpaths.
