The Brent (Restriction of Stopping on Bus Stops) (No. 2) Experimental Traffic Order 1998

Notice is hereby given that the Council of the London Borough of Brent on 26th January 1998 made the above-mentioned Order under section 9 of the Road Traffic Regulation Act 1984, as amended by section 8 of and Part 1 of Schedule 5 to the Local Government Act 1985.   2. The general effect of the Bus Lane Order will be to:   (A) prohibit all vehicles from entering or proceeding in the areas of the carriageway (to be known as “the bus lane”) lying within or adjacent to the lengths of road specified in Schedule 1 to this Notice and between the north-eastern kerb-line of that length of road and a longitudinal single white line marked on the carriageway of that length of road, between 7 a.m. and 7 p.m. on Mondays to Saturdays inclusive. The prohibition will not apply to:       (a) motor vehicles constructed or adapted to carry 8 or more passengers (excluding the driver); and local buses not so constructed or adapted;       (b) dial-a-ride vehicles, pedal cycles, or licensed cabs;       (c) a vehicle being used for ambulance, fire brigade or police purposes if it is reasonably necessary for that vehicle to enter or proceed in the bus lane;       (d) any vehicle being used in connection with the removal of any obstruction in the bus lane;       (e) a vehicle being used for purpose in connection with the statutory powers or duties of a local authority or the supply of gas, water or electricity, or in connection with any building operation, demolition or excavation in or adjacent to the bus lane, provided that in all the circumstances it is reasonably necessary for the vehicle to enter the bus lane;       (f) a vehicle while postal packets addressed to premises adjacent to the bus lane are being unloaded from that vehicle or, having been unloaded therefrom, are being delivered; or while postal packets are being collected for loading on the vehicle from premises or posting boxes adjacent to the bus lane or, having being so collected, are being loaded thereon;       (g) any vehicle which enters the bus lane for the sole purpose of waiting for as long as may reasonably be necessary to enable a person suffering from any disability or injury (including blindness) which seriously impairs that person’s ability to walk or board or alight from that vehicle;       (h) any vehicle which enters or proceeds in the bus lane:         (i) from any road if that vehicle forthwith leaves the bus lane through the gap in the longitudinal single white line situated opposite and adjacent to the junction of that road with the bus lane; or         (ii) from any part of Harrow Road which does not comprise the bus lane through any gap in the longitudinal single white line if that vehicle forthwith enters the road which lies opposite the gap; or         (iii) from any vehicular accessway or crossing over the footway adjoining the bus lane if that vehicle forthwith leaves the bus lane at a point opposite that vehicular accessway or crossing; or         (iv) from any part of Harrow Road which does not comprise the bus lane at a point opposite any vehicular accessway or crossing over the footway adjoining the bus lane if that vehicle forthwith enters that vehicular accessway or crossing;       (i) any vehicle if the driver thereof is obliged to enter or proceed in the bus lane in order to avoid an accident and forthwith causes that vehicle to leave the bus lane;       (j) any vehicle if the driver thereof is required by law to stop and as soon as reasonably practicable thereafter causes that vehicle to leave the bus lane;   (B) apply in a modified form the provisions of the Brent (Waiting and Loading Restriction) Order 1979, so that:       (a) in the length of street specified in Schedule 1 to this Notice:         (i) the hours during which the existing prohibition applies on waiting by vehicles will be changed so that such prohibition will apply between 7 a.m. and 7 p.m. on Mondays to Saturdays inclusive;         (ii) the hours during which the existing prohibition applies on waiting by vehicles for the purpose of delivering or collecting goods or loading or unloading a vehicle will be changed so that such prohibition will apply between 7 a.m. and 10 a.m. and between 4 p.m. and 7 p.m. on Mondays to Saturdays inclusive;       (b) in the lengths of streets specified in Schedule 2 to this Notice the hours during which the existing prohibition applies on waiting by vehicles will be changed so that such prohibition will apply between 7 a.m. and 7 p.m on Mondays to Saturdays inclusive.   3. The general effect of the Bus Stop Clearway Order will be to:   (A) suspend the existing Bus Stop Clearway Restrictions in the length of street specified in Schedule 3 to this Notice;   (B) prohibit all vehicles from stopping at any time in the lengths of street specified in Schedule 4 to this notice.       The prohibition will apply to:       (a) a bus whilst picking up or setting down passengers;       (b) a bus providing a bus service under agreement with London Regional Transport;       (c) a taxi for as long as is necessary to enable a passenger to board or alight;       (d) a vehicle being used for ambulance, fire brigade or police purposes;       (e) any vehicle being used in connection with the removal of any obstruction on or adjacent to the bus stop;       (f) a vehicle being used for a purpose in connection with the statutory powers or duties of a local authority or the supply of gas, water or electricity, or in connection with any building operation, demolition or excavation in or adjacent to the bus stop, provided that in all the circumstances the vehicle cannot conveniently and lawfully be used for that purpose in any part of any street that is not a bus stop;       (g) a person in control of a vehicle who is required by law to stop or is prevented from proceeding in circumstances beyond the drivers control.   4. The prohibitions referred to in paragraph 2 (A) and 3 (B) above will not apply in respect of anything done with the permission or at the direction of a police constable in uniform.   5. The Order has provided that in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, the Council’s Commissioning Director of StreetCare or some person authorised in that behalf by him, may, if it appears to him or that person essential in the interests of the expeditious, convenient and safe movement of traffic or for preserving or improving the amenities of the area through which any road affected by this Order runs, modify or suspend this Order or any provision thereof.   6. A copy of the Order, which will come into operation on 9th February 1998, of a map of the relevant area and of the Council’s statement of reasons for making the Order can be inspected during normal office hours on Mondays to Fridays inclusive until the expiration of a period of six months from that date at: (a) The One Stop Shop, Brent Town Hall, Forty Lane, Wembley, Middlesex HA9 9HX; and (b) The One Stop Shop, Brent House, 349-357 High Road, Wembley, Middlesex HA9 6BZ.   7. Copies of the Order may be purchased from the address mentioned in paragraph 6(b) above.   8. Any person desiring to question the validity of the Order or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Order may, within 6 weeks of the date on which the Order was made, make application for the purpose to the High Court.   9. If the provisions of the Order continue in operation for a period of not less than six months, the Council of the London Borough of Brent will consider in due course whether the provisions of the Order should be reproduced and continued in force indefinitely by means of an Order under section 6 of the said Act of 1984. Persons desiring to object to the making of the Order under section 6 of the said Act of 1984, for the purpose of such reproduction and continuation in force may, within the aforementioned period of six months, send a statement in writing of their objection and the grounds thereof to The Director, Highways Consultancy, 3rd Floor (west), Brent House, 349-357 High Road, Wembley, Middlesex HA9 6BZ, quoting the reference TO/6/010/BFM.
