TOWN AND COUNTRY PLANNING ACT 1990
The Secretary of State for the Environment, Transport and the Regions hereby gives notice that he proposes to make an Order under section 247 of the above Act, which will authorise the stopping-up of irregularly shaped areas of highway at the Cock Pitt, Derby, as detailed below: (1) an irregularly shaped area of highway on the northern side of the existing Cock Pitt island measuring 7,630 square metres; and (2) an irregularly shaped area of highway on the western side of the existing Cock Pitt island, adjacent to the existing bus station, measuring 2,120 square metres. If the Order is made, the stopping-up will be authorised only in order to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted to Naylor Sale and Widdows Ltd. by Derby City Council, on 9th October 1997, under reference DER/12/96/01404/PRI and on 19th December 1997 under reference DER/10/97/01300/PR. The proposed Order will require the provision of new highway and the improvement of existing highway by Metropolitan & District Developments Ltd., maintainable at public expense, and for which the highway authority is to be the Derby City Council. Copies of the draft Order and relevant plan may be inspected at all reasonable hours during the 28 days commencing on 5th May 1998 at the offices of the Derby City Council, Council House, Corporation Street, Derby, and may be obtained free of charge from the Government Office for the East Midlands (quoting reference EMCM 505035/1/204) at the address below. Any person may object to the making of the proposed Order within the period of 28 days commencing on 5th May 1998 by notice to the Secretary of State for the Environment, Transport and the Regions quoting the above reference, at the Government Office for the East Midlands, Transport, The Belgrave Centre, Stanley Place, Talbot Street, Nottingham NG1 5GG. In preparing an objection it should be borne in mind that the substance of it may be imparted to other persons who may be affected by it and that those persons may wish to communicate with the objector about it.
