LAND COMPENSATION ACT 1973 (AS AMENDED)
A13 Blackwall Tunnel/Cotton Street

The Secretary of State for the Environment, Transport and the Regions hereby gives notice that the length of highway detailed in the Schedule below was first open to public traffic on 6th September 1996.   Under Part 1 of the Land Compensation Act 1973 (as amended) there is a right to compensation in respect of any depreciation of more than £50 in the value of certain interests in land caused by the use of new or altered highways and resulting from specified physical factors (noise, vibration, smell, fumes, smoke, artificial lighting and the discharge on to the land of any solid or liquid substance). Compensation is assessed by reference to prices current at a date 12 months after the highway is first open to public traffic or, in the case of an altered highway, first open to public traffic after completion of the alterations.   Interests qualifying for compensation are specified in section 2 of the above-mentioned Act and there are special provisions relating to claims by mortgagees and persons entitled under trusts or settlements. However, no compensation can be paid under Part 1 where part of the property has been acquired for the purpose of constructing the highway.   Persons entitled to a qualifying interest who consider they have a claim under these provisions may obtain further information and claim forms from the Highways Agency, Project Services, Lands, Federated House, London Road, Dorking RH4 1SZ, telephone (01306) 878401, please ask for Mrs. Pamela Baker.   Claims may be made 12 twelve months after the date when the new or altered highway was first open to public traffic, that is on 6th September 1997 (the “first claim day”). Claims should be made within 6 years from this date. However, any persons who within the 12 months preceding this date make a contract for either (i) disposing of their interest; or (ii) granting a tenancy (insofar as the interest is in land which is not a dwelling) may make a claim within that period and must do so before the interest is disposed of or the tenancy granted. Compensation in such cases will not be payable before the first claim day.   As the first public notice announcing the claim period was not published at the appropriate time the Highways Agency has agreed exceptionally to consider retrospective claims for ex-gratia consideration made by any residents who owned their property on 6th September 1996. These claims must be made by 4th September 1998. Simple interest will be paid from the earlier claim date until the date payment is made. Claims received after 4th September 1998 will receive interest from the date the claim is received. P. M.   A junction improvement, including slip roads between the points described below, clockwise from north:    A102 Blackwall Tunnel Approach Road, southwards from a point 60 metres south of Etrick Street.    A13 East India Dock Road, westwards from a point 96 metres west of Nutmeg Lane.    A102 Blackwall Tunnel Northern Approach Road, northwards from a point 25 metres south of its junction with Woolmore Street.    Cotton Street, northwards from a point 78 metres south of its junction with the A13 East India Dock Road.    A13 East India Dock Road, eastwards from a point 85 metres west of its junction with Cotton Street.    Follet Street, eastwards from a point 10 metres west of its junction with the A13 to A102 Northbound slip road.
