Highway at Abbey Road, Malvern, Worcestershire

The Secretary of State for the Environment, Transport and the Regions hereby gives notice that he has made an Order entitled “the Extinguishment of Vehicular Rights (County of Worcestershire) (No. 1) Order 1998”. This Order comes into operation on extinguishing any right which persons may have to use vehicles (other than those specified in Schedule 2 to the Order) on lengths of Abbey Road, Malvern.   Copies of the Order may be obtained, free of charge, by applying to the office of the Director, Planning, Transport and Environment, Government Office for the West Midlands, 1st Floor, 77 Paradise Circus, Queensway, Birmingham B1 2DT (quoting Ref. No. 5058/35/1/22) and may be inspected at all reasonable hours at the offices of Malvern Hills District Council, Council House, Avenue Road, Malvern, Worcestershire WR14 3AF.   If any person aggrieved by the Order desires to question its validity or the validity of any provision contained in it, on the grounds that it is not within the powers conferred by the above Act or that any requirement of that Act or of any regulation made under it has not been complied with in relation to the Order, he or she may, within 6 weeks from 12th June 1998, apply to the High Court for the suspension or quashing of the Order or of any provision contained in it.   Unless the Order is suspended or quashed as a consequence of any such application, any person who on 12th June 1998, has an interest in land having lawful access to a highway to which the Order relates may claim to be compensated by Malvern Hills District Council in respect of any depreciation in the value of his or her interest which is directly attributable to the Order and of any other loss or damage which is so attributable. Any claim must be served on the Council at its above address within a period of 6 months from 12th June 1998, unless the period is extended in any particular case by the Secretary of State. S. M.
