Proposed Stopping-up of Highways at Kearsley, Bolton

The Secretary of State for the Environment, Transport and the Regions hereby gives notice that on the application of Bullivant Jones & Company on behalf of Morbaine Limited, he proposes to make an Order under section 247 of the above Act, which will authorise the stopping-up of Old Hall Street and Thomas Street at Kearsley, Bolton.   The Order shall provide for the provision of a new highway and a new footpath.   The proposed Order will not be made unless planning permission for the development described in the Schedule to this notice is granted, and in that event the stopping-up will be authorised only in order to enable that development to be carried out in accordance with that planning permission. Planning permission for that development was applied for by Morbaine Limited to Bolton Metropolitan Borough Council under application number 51967/97 and the application stands referred to the Secretary of State in pursuance of a direction under section 77 of the above Act.   Copies of the draft Order and relevant plan may be inspected at all reasonable hours during the 28 days commencing on 10th September 1998, at the Town Hall, Bolton and may be obtained, free of charge, from the Government Office for the North West (Transport) (quoting Ref. GO/TNW 5080/35/1/26) at the address stated below.   Any person may object to the making of the proposed Order within the period of 28 days commencing on 10th September 1998, by notice to the Secretary of State for the Environment, Transport and the Regions, quoting the above reference, at the Government Office for the North West (Transport), Sunley Tower, Piccadilly Plaza, Manchester M1 4BE.   In preparing an objection it should be borne in mind that the substance of it may be imparted to other persons who may be affected by it and that those persons may wish to communicate with the objector about it.
