TOWN AND COUNTRY PLANNING ACT 1990

The Secretary of State for the Environment, Transport and the Regions hereby gives notice that he has made an Order under section 247 of the above Act entitled “The Stopping-up of Highways (County of Durham) (No. 11) Order 1998” authorising the stopping-up of lengths of Highway at and in the vicinity of Houndgate and Beaumont Street, Darlington, County Durham, to enable the development described in the Schedule to this notice to be carried out in accordance with outline planning permission granted to Town Planning Consultancy Ltd. on behalf of Simons Estates Limited and North East Bus Limited by Darlington Borough Council on 25th February 1998, under Ref. 8/97/644/DM.
  Copies of the Order may be obtained, free of charge, on application to the Secretary of State at the offices of the Director Planning, Environment and Transport, Government Office for the North East, Wellbar House, Gallowgate, Newcastle-upon-Tyne NE1 4TD (quoting GO-NE/98/5053/35/5), and may be inspected at all reasonable hours at the offices of Darlington Borough Council, Town Hall, (Reception Area), Darlington, County Durham DL1 5QT.
  Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of 2nd October 1998, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

Schedule

  The outline planning permission is granted for construction of a multiplex arena development and other leisure development (Class D2) food and drink development (Class D3), multi-storey car park, relocation of area for storage of market stalls, bus and coach lay-by facilities, together with servicing and access at Feethams bus depot and adjoining land north of Beaumont Street Darlington.
