Note: The Scheme which follows this note has been made under section 28 of the Post Office Act 1969 and amends the Post Office Inland Letter Post Scheme 1989. The Scheme, which comes into operation on 12th October 1998, makes various amendments to the registered and Special Delivery services.

THE POST OFFICE INLAND LETTER POST AMENDMENT (NO. 11) SCHEME 1998

     Made  -  -  -  - 2nd October 1998         Coming into operation 12th October 1998       The Post Office, by virtue of the powers conferred on it by section 28 of the Post Office Act 1969 and all other powers enabling it in this behalf, hereby makes the following Scheme: 1.  Commencement and Citation   (i) This Scheme shall come into operation on 12th October 1998 and may be cited as the Post Office Inland Letter Post Amendment (No. 11) Scheme 1998.   (ii) This Scheme shall be read as one with the Post Office Inland Letter Post Scheme 1989 (Post Office Scheme L1/1989) (hereinafter called “the Scheme”). 2.  Interpretation   In sub-paragraph (1) of paragraph 3 of the Scheme the words “express packet means a packet sent by the Special Delivery service set out in paragraph 24” shall be deleted.   In sub-paragraph (1) of paragraph 3 of the Scheme the words “Registered Packet means a packet sent by the registered service set out in paragraph 34” shall be deleted and “Special Delivery packet means a packet sent by the Special Delivery service set out in paragraph 34. Special Delivery is a brand name which the Post Office uses to denote the type of service previously provided by the Registered post service. Any reference in any legislation or legal document to “Registered Post” or “the Registered Service” shall be taken to be a reference to Special Delivery as it is the same service in all material particulars.” shall be inserted in their place.   In sub-paragraph (1) of paragraph 3 of the Scheme the words “Registered Plus means a form or registered service where a higher fee is paid and maximum compensation payable is increased” shall be deleted. 3.  Application   In sub-paragraph (2) of paragraph 4 of the Scheme the words “as a Special Delivery packet” shall be added after the word “registration”. 4.  Express Delivery   Paragraph 24 shall be deleted. 5.  Recorded Delivery   In sub-paragraph (2) of paragraph 25 of the Scheme the words “any unregistered postal packet (other than an express packet)” shall be deleted and “any postal packet that is not a Special Delivery packet” shall be inserted in their place.   In sub-paragraph (6) of paragraph 25 of the Scheme the words “If an unregistered postal packet” shall be deleted and “If a packet not registered as a Special Delivery packet” shall be inserted in their place. 6.  Response Services with Special Delivery   A new paragraph 27 of the Scheme shall be added as follows:   “27 (1) The Post Office may grant a licence to a person who wishes to invite others to post Special Delivery packets to him or his agent subject to such conditions as the Post Office may think fit.   27(2) The terms and conditions of such a licence shall be the same as those set out in paragraph 36 provided that no such response packets may be posted otherwise than at a Post Office unless otherwise agreed with the Post Office.   27(3) Unless otherwise agreed with the Post Office, the conditions applying to such packets shall be the same as those set out in paragraphs 34, 35, 36, 37 & 38 and Schedule 4 Part II of the Scheme”. 7.  Redirection by the public   In sub-paragraph (1) of paragraph 28 of the Scheme the words “An express” shall be deleted and “A Special Delivery” shall be inserted in their place.   In sub-paragraph (3)(a) of paragraph 28 of the Scheme the word “registered” shall be deleted and “Special Delivery” shall be inserted in its place.   Sub-paragraph (3)(c) of paragraph 28 of the Scheme shall be deleted. 8.  Packets for which the Post Office accepts liability   In sub-paragraph (7) of paragraph 33 of the Scheme the word “registration” shall be deleted and the words “Special Delivery” inserted in its place. 9.  Part VII   In part VII the title “REGISTRATION” shall be deleted and “SPECIAL DELIVERY” inserted in its place. 10.  Registration   In part VII the sub-title “Registration” shall be deleted and “Special Delivery” inserted in its place.   In sub-paragraph (1) of paragraph 34 of the Scheme the number “30” shall be deleted and “10” inserted in its place.   In sub-paragraph (1) of paragraph 34 of the Scheme the word “registered” shall be deleted and “Special Delivery” inserted in its place.   In sub-paragraph (2) of paragraph 34 of the Scheme the word “registered” shall be deleted and “Special Delivery” inserted in its place.   In sub-paragraph (2) of paragraph 34 of the Scheme the words “the registered or either of the Registered Plus” shall be deleted and “any of the Special Delivery” inserted in their place. 11.  Conditions as to registered packets   In the sub-title for paragraph 35 of the Scheme the word “registered” shall be deleted and “Special Delivery” inserted in its place.   In paragraph 35 of the Scheme the word “registered” shall be deleted and “Special Delivery” inserted in its place. 12.  Receipts for registered packets   In the sub-title for paragraph 36 of the Scheme the word “registered” shall be deleted and “Special Delivery” inserted in its place.   In paragraph 36 of the Scheme the word “registered” shall be deleted and ”Special Delivery” inserted in its place. 13.  Compulsory registration   In the sub-title of paragraph 37 of the Scheme the word “registration” shall be deleted and “Special Delivery” inserted in its place.   Sub-paragraph (1) of paragraph 37 of the Scheme shall be deleted and the following inserted in its place. “If any postal packet having written or impressed on it (or on its envelope or cover) the word “Special Delivery”, or any other word, phrase or mark conveying the impression that the packet is a Special Delivery packet or is intended to be set via Special Delivery, is found in the post or left at a Post Office, and the packet has not been marked as Special Delivery by the Post Office, it shall be marked as Special Delivery (whether or not it is eligible as a Special Delivery packet under paragraph 34(1)), and may be detained for that purpose at any Post Office through which it passes.”   In sub-paragraph (2) of paragraph 37 of the Scheme the words “an unregistered” shall be deleted and “a” inserted after “where” and “which has not been sent by Special Delivery” inserted after packet.   In sub-paragraph (2)(h) of paragraph 37 of the Scheme the word “registered” shall be deleted and “sent by the Special Delivery service” inserted in its place.   In sub-paragraph (2)(h) of paragraph 37 of the Scheme the word “for registration” shall be deleted and “as a Special Delivery packet” inserted in its place.   In sub-paragraph (3) of paragraph 37 of the Scheme the word “registration” shall be deleted and “Special Delivery” inserted in its place. 14.  Compensation for registered packets   In the sub-title for paragraph 38 the word “registered” shall be deleted and “Special Delivery” inserted in its place.   In sub-paragraph (1) of paragraph 38 of the Scheme the word “registered” shall be deleted and “Special Delivery” inserted in its place.   In sub-paragraph (3) of paragraph 38 of the Scheme the word “registered” shall be deleted and “Special Delivery” inserted in its place.   In sub-paragraph (4) of paragraph 38 of the Scheme the word “registered” shall be deleted and “Special Delivery” inserted in its place. 15.  Compensation for certain other postal packets   In sub-paragraph (1) of paragraph 39 of the Scheme the words “registered packet, an express packet” shall be deleted and “Special Delivery packet,” shall be inserted in their place. 16.  Compensation for express packets   Paragraph 40 of the Scheme shall be deleted. 17.  Registered postal packets to and from the Channel Islands or the Isle of Man   In the sub-title the word “Registered” shall be deleted and “Special Delivery” inserted in its place.   In sub-paragraph (1) of paragraph 51 of the Scheme the word “registered” shall be deleted and “Special Delivery” shall be inserted in its place.   In sub-paragraph (2) of paragraph 51 of the Scheme the word “registered” shall be deleted and “Special Delivery” shall be inserted in its place.   In sub-paragraph (2)(b) of paragraph 51 of the Scheme the word “registration” shall be deleted and “Special Delivery” shall be inserted in its place. 18.  Postal Facilities   In Schedule 3 paragraph 3 the words “a registered or express” shall be deleted.   In the note to Schedule 3 paragraph 7(b) the word “registered” shall be deleted and “Special Delivery” shall be inserted in its place.   In Schedule 3 paragraph 11 the words “registered postal packets and express packets” shall be deleted and “Special Delivery” shall be inserted in their place. 19.  Express and registered postal packets   In the title of Schedule 4 the words “express and registered” shall be deleted and “Special Delivery” inserted in their place.   In Schedule 4 Part 1 the table containing the rates of postage and compensation limits shall be deleted and the following inserted in its place.

20.  Conditions which must be complied with   In Schedule 4 Part II paragraph 1 the words “registered post” shall be deleted and “Special Delivery” inserted in their place.   In Schedule 4 Part II paragraph 1(a) the word “registration” shall be deleted and “Special Delivery” inserted in its place.   In Schedule 4 Part II paragraph 1(b) both of the words “registration” shall be deleted and “Special Delivery” inserted in their place.   In Schedule 4 Part II paragraph 1(b) the word “registered” shall be deleted and “Special Delivery” inserted in its place.   In Schedule 4 Part II paragraph 2(1) the word “registered“ shall be deleted and “Special Delivery” inserted in its place.   In Schedule 4 Part II paragraph 2(2) the word “registered” shall be deleted and “Special Delivery” inserted in its place.   In Schedule 4 Part II paragraph 2(3) the word “registered” shall be deleted and “Special Delivery” inserted in its place.   In Schedule 4 Part II paragraph 2(3) the word “registration” shall be deleted and “Special Delivery” inserted in its place.   In Schedule 4 Part II paragraph 2(3)(1) the words “registered post” shall be deleted and “Special Delivery” inserted in its place.   In Schedule 4 Part II paragraph 2(3)(2) the words “Except . . . registered newspaper” shall be deleted and the following inserted in their place: “A packet for transmission by Special Delivery shall be fastened as follows:”.   In Schedule 4 Part II paragraph 2(5) the word “registered” shall be deleted and the words “Special Delivery” inserted in its place.   In Schedule 4 Part II paragraph 4 the words “registered post” shall be deleted and “Special Delivery” inserted in their place. 21.  Compensation for express and certain other packets   In the title of Schedule 5 the words “express and” shall be deleted.   In Schedule 5 paragraph 5 the word “registered” shall be deleted and “a Special Delivery packet” inserted in its place.
