CLEAN AIR ACT 1993
THE CHORLEY BOROUGH COUNCIL (GILLIBRAND FIELDS) SMOKE CONTROL ORDER NO. 1, 1999
Notice is hereby given that the Chorley Borough Council in exercise of the powers
conferred on them by section 18 of the Clean Air Act 1993, propose to make an Order
entitled the Chorley Borough Council (Gillibrand Fields) Smoke Control Order No. 1,
1999, declaring the area described in the Schedule hereto to be a smoke control area.
Subject to the limitations and exemptions provided by the Order and by virtue of
section 21 of the Act if, on any day after the Order has come into operation, smoke
is emitted from a chimney of any building within the smoke control area the occupier
of that building shall be guilty of an offence and liable on summary conviction to
a fine not exceeding level 3 on the standard scale unless he proves that the emission
of smoke was not caused by the use of any fuel other than an authorised fuel. The
authorised fuels include anthracite, coke and other carbonised fuels, gas and electricity,
and fuels authorised by the Secretary of State for the Environment, Transport and
the Regions in Regulations under sections 20(6) and 63(1) of the Clean Air Act 1993.
The following 5 existing dwellings, all sited off Clover Road, Chorley, shall be
excluded from the provisions of the Order, namely, Grundy’s Farm, Byabarn, Harley
House, Valley View and Higher Kingsley.
Copies of the Order (and of the map referred to therein) may be inspected, free of
charge, at Reception, Town Hall, Chorley, or at the Environmental Services Unit, Council
Offices, Union Street, Chorley, at all reasonable times during the period of 6 weeks
from 29th July to 12th September 1999.
Within the said period any person who will be affected by the Order may by notice
in writing to the Borough Solicitor, Town Hall, Market Street, Chorley PR7 1DP, object
to the making of the Order.
Schedule
The area which forms the subject of the Order is shown edged green on the Order map,
and may be broadly described as being bounded by Big Wood and Copperworks Woods on
the north, the grounds of Gillibrand Hall on the east, Southlands High School on the
south and the projected line of the Gillibrand Link Road on the west.
