WILDIFE AND COUNTRYSIDE ACT 1981, SECTION 34

Notice is hereby given that on 29th November 1999 the Secretary of State for the Environment, acting under the provisions of section 34(2) and paragraphs 3(1) and 6(2) of Schedule 11 to the Wildlife and Countryside Act 1981, having considered the following unopposed Yorkshire Dales National Park Authority Limestone Pavement Orders, which took effect when they were made on 15th September 1999, decided to take no action on the Orders. This means that the Orders continue in force. (i) Sulber, Moughton, Thwaite, Clapdale and Simon Fell Limestone Pavement Order No. 8 (Austwick, Clapham-Cum-Newby and Horton-in-Ribblesdale) 1999. (ii) Hesleden Bergh and Pen-y-Ghent Gill Limestone Pavement Order No. 9 (Halton Gill and Litton) 1999. (iii) Cowside to Kilnsey Limestone Pavement Order No. 10 (Arncliffe, Hawskwick, Conistone-with-Kilnsey, Bordley and Malham Moor) 1999. (iv) Northwest Ingleborough Limestone Pavement Order No. 11 (Ingleton, Clapham-cum-Newby and Horton-in-Ribblesdale) 1999. (v) Ewe Moor LPO No. 12 (Malham and Malham Moor) 1999. (vi) Malham Lings LPO No. 13 (Malham and Malham Moor) 1999. The Orders designate the lands described in the Schedule to the Orders in accordance with section 34(2) of the Act and prohibit the removal or disturbance of limestone on or in that land. Copies of the Orders and maps referred to in them and of this notice have been deposited at the Yorkshire Dales National Park Authority Offices at Yorebridge House, Bainbridge, Leyburn, North Yorkshire DL8 3EE and Colvend, Hebden Road, Grassington, Skipton, North Yorkshire BD23 5LB, and may be seen at all reasonable hours. Any person who is aggrieved by any of the Orders and desires to question its validity on the grounds that it is not within the powers of section 34 of the said Act of 1981, or that any of the requirements of Schedule 11 of that Act had not been complied with in relation to it, may within 6 weeks from the date of this notice make an application to the High Court under paragraph 7 of Schedule 11 to the 1981 Act.
