THE A13 TRUNK ORAD (A112 PRINCE REGENT LANE JUNCTION IMPROVEMENT) SUPPLEMENTARY COMPULSORY PURCHASE ORDER (NO. PS 12) 1999

Whereas the A13 Trunk Road (A112 Prince Regent Lane Junction Improvement) Compulsory Purchase Order (No. PS 11) 1999 and the A13 Trunk Road (A112 Prince Regent Lane Junction Improvement) Supplementary Compulsory Purchase Order (No. PS 12) 1999, which have been made by the Secretary of State for the Environment, Transport and the Regions, include the land described in the First Schedule to this notice and the new rights described in the Second Schedule. And whereas the said land and the land over which the said new rights are to be acquired form parts of open spaces. Notice is hereby given that the Secretary of State, in exercise of his powers under section 19(1)(a) of, and paragraph 6(1)(b) of Schedule 3 to, the Acquisition of Land Act 1981, has certified that he is satisfied that there has been or will be given in exchange for the land described in the First Schedule hereto, being parts of open spaces within the meaning of the said Act, and for the rights described in the Second Schedle hereto, the land described in the Third Schedule hereto, which: (a) is not less in area and is equally advantageous to the persons, if any, entitled to rights of common or other rights, and to the public, and that the land given in exchange has been or will be vested in the persons in whom the said open spaces were vested, and subject to the like rights, trusts and incidents as attach to the said open spaces; and (b) will as respects the persons in whom there is vested the land over which the rights are to be acquired, the persons, if any, entitled to rights of common or other rights over that land, and the public, be adequate to compensate them for the disadvantages which result from the acquisition of the rights, and that the additional land has been or will be vested in the persons in whom there is vested the land over which the rights are to be acquired, and subject to the like rights, trusts and incidents as attach to that land apart from the compulsory purchase orders. A plan showing the land to which the certificate relates and the land proposed to be given in exchange, which is described in the Third Schedule to this notice, may be inspected at the offices of the London Borough of Newham, Town Hall, Barking Road, East Ham, London E6 2RP; at Custom House Library, Prince Regent Lane, London E16 3JJ; at the Highways Agency, Federated House, London Road, Dorking RH4 1SZ; and at the Highways Agency, Room 5/46A, St. Christopher House, Southwark Street, London SE1 0TE, at all reasonable hours until 3rd February 2000. The certificate becomes operatives on the date on which this notice is first published; but a person aggrieved by the certificate may, by application to the High Court within 6 weeks from that date, question its validity on the ground that there has been a failure to comply with any relevant statutory requirement relating to the certificate. Webbe, a Grade 7 Officer in the Highways Agency First Schedule 4,917 square metres of open space known as Canning Town Recreation Ground, including part of tennis courts, trees, footpaths and public conveniences, south of the A13 (Newham Way) and east of Freemasons Road, London E.16, numbered Plots 25 and 25G and shown coloured pink on the plan referred to in the above-named Compulsory Purchase Orders; 4,840 square metres of open space known as Canning Town Recreation Ground, including part of tennis courts, trees, footpath and public conveniences, south of the A13 (Newham Way) and east of Freemasons Road, London E.16, numbered Plots 25D and 25H and shown coloured pink on the said plan; 11 square metres of open space forming part of access to Canning Town Recreation Ground, east of Freemasons Road, London E.16, numbered Plot 25J and shown coloured pink on the said plan; 7,270 square metres of open space known as Prince Regent Lane Playing Field, including part of all-weather synthetic pitch, associated lighting columns, access and part of playground, north of the A13 (Newham Way) and east of its junction with the A112 (Prince Regent Lane) London E.13, numbered Plots 69, 69C and 69D and shown coloured pink on the said plan; 4 square metres of open space forming part of access north of the A13 (Newham Way) London E.13, numbered Plot 69B and shown coloured pink on the said plan; 23 square metres of open space known as Beckton District Park south of the A13 (Newham Way), London E.16 numbered Plot 91A and shown coloured pink on the said plan; and 17 square metres of open space known as Beckton District Park south of the A13 (Newham Way), London E.16, number Plot 91B and shown coloured pink on the said plan. Second Schedule The right to construct and maintain a retaining wall and boundary wall in 377 square metres of open space known as the Canning Town Recreation Ground, including part of tennis court and footpaths, south of the A13 (Newham Way), and east of Freemasons Road, London E.16, numbered Plot 25B and shown coloured blue on the said plan; and The right to construct and maintain boundary wall in 630 square metres of open space known as the Canning Town Recreation Ground, including part of tennis court, trees and footpath, south of the A13 (Newham Way), and east of Freemasons Road, London E.16, numbered Plot 25F and shown coloured blue on the said plan. Third Schedule 8,085 square metres of wasteland west of Freemasons Road and north of Russell Road, London E.16, numbered Plot 93 and shown coloured green on the said plan; and 10,004 square metres of part of former school playing field adjacent to Rosetta Primary School, east of Freemasons Road, London E.16, numbered Plots 92 and 92A and shown coloured green on the said plan. 17th December 1999.
