NOTICE OF GIVING OF A CERTIFICATE UNDER SECTION 19(1)(a) TO THE ACQUISITION OF LAND ACT 1981
THE BIRMINGHAM NORTHERN RELIEF ROAD (BURNTWOOD TO WEEFORD SECTION) COMPULSORY PURCHASE ORDER (NO. PS 3) 1998
HAMMERWICH VILLAGE GREEN (VG31)

Whereas the Birmingham Northern Relief Road (Burntwood to Weeford Section) Compulsory Purchase Order (No. PS 3) 1998, which has been made by the Secretary of State for the Environment, Transport and the Regions, includes the land described in the First Schedule hereto;
And whereas the said land forms part of Hammerwich Village Green (VG31) common land;
And whereas it is proposed that that the land described in the Second Schedule hereto shall be given in exchange for the said land;

Notice is hereby given that the Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred to him by section 19 of the above-mentioned Act has certified that under section 19(1)(a), that he is satisfied; that there will be given in exchange for the land described in Schedule 1 hereto, being part of a common within the meaning of the said Act, the land described in Schedule 2 hereto, which is not less in area and is equally advantageous to the persons, if any, entitled to rights of common or other rights, and to the public, and that the land to be given in exchange will be vested in the persons in whom the said common is vested, and subject to the like rights, trusts and incidents as attach to the common.
Plans showing in pink colour the land described in Schedule 1 hereto and in green colour the land described in Schedule 2 may be inspected at all reasonable hours from 10th February 2000 to 23 March 2000, at the Highways Agency, 5 Broadway, Broad Street, Birmingham B15 1BL, and at Burntwood and Chase Terrace Library, Sankeys Corner, Burntwood; Brownhills Library, Brickiln Street, Brownhills, Walsall, and Shenstone Library, Main Street, Shenstone.
The certificate becomes operative on the date on which this notice is first published, but if application is made to the High Court under section 23 of the Acquisition of Land Act 1981, within a period of 6 weeks from that date by any person aggrieved by the certificate the Court, may, by Interim Order, suspend the operation of the certificate either generally or in so far as it affects any property of the applicant, and may, if satisfied that the interests of the applicant have been substantially prejudiced by any requirement of the said Act or of any regulation made under section 7 thereof not having been complied with, quash the certificate either generally or in so far as it affects any property of the applicant.

Schedule 1Two areas of common land in the parish of Hammerwich in the district of Lichfield in the county of Staffordshire, with a total area of 1,105 square metres, being public open space, comprising parts of Hammerwich Village Green (VG31) north-east of Brownhills (part of OS 8792) (SK 0506), shown coloured pink on the plan referred to in the above mentioned Compulsory Purchase Order and comprising Plot 30/379b, but excluding the half width of Hanney Hay Road. The land is also shown coloured pink and numbered Plots 1B and 1C on plan number K41-CEH-01A(-).
Schedule 28,350 square metres of grassland in the parish of Hammerwich in the district of Lichfield in the county of Staffordshire, north of Coppy Nook Lane, east of Hospital Road at Burntwood (part OS 0030) (SK 0508, SK 0608), shown coloured green on the above-mentioned plan and numbered Plot 30/329a. The land is also shown coloured green and numbered Plot 1F on plan number K41-CEH-01A(-).
