ACQUISITION OF LAND ACT 1981
NOTICE OF GIVING OF A CERTIFICATE UNDER SECTION 19(1)(a) AND PARAGRAPH 6(1)(a) OF SCHEDULE 3 TO THE ACQUISITION OF LAND ACT 1981
THE BIRMINGHAM NORTHERN RELIEF ROAD (CHURCHBRIDGE TO BURNTWOOD SECTION) COMPULSORY PURCHASE ORDER (NO. PS 2) 1998
LAND AT CHASEWATER
Whereas the Birmingham Northern Relief Road (Churchbridge to Burntwood section) Compulsory
Purchase Order (No. PS 2) 1998, which has been made by the Secretary of State for
the Environment, Transport and the Regions, includes the land and rights over land
described in the First and Second Schedules hereto;
And whereas the said land and the land over which the said rights are to be created
forms part of Chasewater public open space;
And whereas it is proposed that the land described in the Third Schedule of the Schedule
hereto shall be given in exchange for the said land;
Notice is hereby given that the Secretary of State for the Environment, Transport
and the Regions, in exercise of the powers conferred to him by section 19 of the above-mentioned
Act and also by paragraph 6(1)(a) of Schedule 3 to the said Act has certified that
he is satisfied that:
(a) there has been or will be given in exchange for the land described in the First
Schedule hereto, being parts of open spaces within the meaning of the said Act, the
land described in the Third Schedule hereto, which is not less in area and is equally
advantageous to the persons, if any, entitled to rights of common or other rights,
and to the public, and that the land given in exchange has been or will be vested
in the persons in whom the said open spaces were vested, and subject to the like rights,
trusts and incidents as attach to the said open spaces; and
(b) the land described in the Second Schedule hereto, being parts of open spaces
within the meaning of the said Act, when burdened with the rights described in that
Schedule, will be no less advantageous to those persons in whom it is vested and other
persons, if any, entitled to rights of common or other rights, and to the public,
than it was before.
Plans showing in pink and blue colour the land described in the First and Second
Schedules hereto and in green colour the land described in the Third Schedule may
be inspected at all reasonable hours from 10th February 2000 to 23rd March 2000 at:
the Highways Agency, No. 5 Broadway, Broad Street, Birmingham B15 1BL and at Norton
Canes Library, Burntwood Road, Norton Canes, Cannock; Burntwood and Chase Terrace
Library, Sankeys Corner, Burntwood and Brownhills Library, Brickiln Street, Brownhills,
Walsall.
The certificate becomes operative on the date on which this notice is first published,
but if application is made to the High Court under section 23 of the Acquisition of
Land Act 1981 within a period of 6 weeks from that date by any person aggrieved by
the certificate the Court may, by interim order, suspend the operation of the certificate
generally or in so far as it affects any property of the applicant, and may, if satisfied
that the interests of the applicant have been substantially prejudiced by any requirement
of the said Act or of any regulation made under section 7 thereof not having been
complied with, quash the certificate either generally or in so far as it affects any
property of the applicant.
