NOTICE UNDER SECTION 38—WITHDRAWAL OF SUPPORT—CARRINGTON FARM

This notice relates to the extraction of coal from within the approved site boundary at Carrington Farm Opencast Coal Site, Smalley, Derbyshire. The proposed operations are the subject of planning permission CM6/500/11 as approved by Derbyshire County Council, dated 9th November 2000. The land to which this notice relates is identified on drawing number HJB/292/PA36, which is deposited at the Managers Office, Carrington Farm Opencast Coal Site, Heanor Road, Smalley, Derbyshire, and is available for inspection between the hours of 8 a.m. and 5 p.m. Mondays to Fridays, except public holidays. H J Banks & Company Limited, whose registered office is at West Cornforth, Ferryhill, County Durham DL17 9EU, has the approval of the Coal Authority for the giving of such a notice relating to the land in question. H. J. Banks & Company Limited hereby give notice that there are proposals to undertake auger mining operations, which may require the exercise in relation to the land identified on drawing number HJB/292/PA36, of such a right as is mentioned in section 38(1) of the Coal Industry Act 1994, namely to withdraw support from any land to which the section 38 applies.
