THE CONSERVATION (NATURAL HABITATS, &C.) REGULATIONS 1994 REGULATION 22 FENN’S WHIXALL (SHROPSHIRE) SPECIAL NATURE CONSERVATION ORDER 2000

Notice is hereby given under paragraph 6 of Schedule 1 to the Conservation (Natural Habitats, &c.) Regulations 1994 (“the Regulations”) that the Secretary of State, having considered the objections and representations duly made in respect of the above-named Order and the report of the person appointed to hold a public inquiry, has considered the above-named Order, and does not propose to amend or revoke it. In consequence, the Order, which took effect on 31st May 2000, will continue in force. The general effect of the Order is to prohibit any person from carrying out the operations specified in Schedule 2 to the Order on the land described in Schedule 1 to the Order (an area of some 2.74 hectares of land within the Fenn’s, Whixall, Bettisfield, Wem and Cadney Mosses candidate Special Area of Conservation (cSAC), the exact delineation of which is set out on the plan referred to in the Order). Copies of the Order and the map referred to in it, and this notice, have been desposited at the offices of the North Shropshire District Council, Edinburgh House, New Street, Wem, Shrewsbury. They may be inspected, free of charge, at all reasonable hours. Any person who is aggrieved by the Order, and desires to question its validity on the grounds that it is not within the powers of regulation 22 of the 1994 regulations, or that any of the requirements of Schedule 1 had not been complied with in relation to it may, within 6 weeks from the date of this notice, make an application to the Court, under paragraph 7 of the said Schedule 1.
