NOTICE TO CREDITORS AND BENEFICIARIES UNDER SECTION 27 OF THE TRUSTEE ACT 1925

Pursuant to section 27 of the Trustee Act 1925 and any other relevant power, notice is given that any Member, other Beneficiary, Creditor or anyone else having any claim against, or claiming to be beneficially interested in, the assets of the Dalgety Pension Fund is required to send to the Trustees of the Dalgety Pension Fund, c/o Jardine Lloyd Thompson Benefit Solutions Ltd, Bancroft House, 251 High Street, Orpington, Kent BR6 0NT, on or before 31 July 2002, written particulars of the claim, and in due course the Trustee will proceed to secure the benefits of anyone claiming under the Fund having regard only to the claims of which it then has notice, and in respect of the assets of the Fund so used will not be liable to anyone of whose claim it then has had no notice. This notice is also directed to any former employee of either Dalgety plc, Sygen International plc, (or any associated Company of either of these Companies) and who may have a claim against the assets of the Fund by virtue of having been unlawfully excluded from membership of it. Members of the Fund and other beneficiaries with whom the Trustee or the Fund’s Administrators are already in contact need not respond to this notice since their interests have already been noted.
