THE TRESPAPHAN UK PENSION SCHEME

PURSUANT TO SECTION 27, TRUSTEE ACT 1925 (AS AMENDED)

To: All employees and former employees of Trespaphan UK Limited (formerly known as Hoechst Trespapham UK Limited) and to any widows/widowers, children and other dependants of such employees or former employees and to any Creditor or other person having a claim to be beneficially interested in the Trespaphan UK Pension Scheme (“the Scheme”). The Scheme is in the process of being wound up. This means that the Trustee of the Scheme, Trespaphan Pension Trustees Limited, must establish who are the beneficiaries of the Scheme and what their entitlements are as well as who else may have a claim against the Scheme or its assets. This will enable the Trustee to arrange for the assets of the Scheme to be used to provide the pensions and benefits payable under the Scheme. If you have not already received a communication about the winding-up of the Scheme and you have, or consider that you may have, a right to benefit under the Scheme to a claim against the Scheme, you must send written particulars of your claim or interest, by registered post, to the undersigned so as to arrive by no later than 28 February 2003. After this date, the Trustee of the Scheme will distribute the remaining Scheme assets, in accordance with the provisions of the Scheme, among those entitled thereto having regard only to the claims and interests of which they shall then have had notice. Unless the Trustees already have notice of your rights to benefits, or your claim against the Scheme, you will lose your rights after 28 February 2003. This notice concerns only those persons who have not received correspondence or notification of the winding-up from the Trustee of the Scheme.
