GREATER MANCHESTER (LIGHT RAPID TRANSIT SYSTEM) ORDER
NOTICE OF APPLICATION FOR AN ORDER
Greater Manchester Passenger Transport Executive (GMPTE) of 9 Portland Street, Piccadilly Gardens, Manchester M60 1HX is applying to the First Secretary of State under section 6 of the Transport and Works Act 1992 for the above-mentioned Order under section 1 of that Act. The proposed Order would modify the obligations of GMPTE under the Greater Manchester (Light Rapid Transit System) Acts and Orders 1988 to date so that the requirements respecting the levels of rails can be construed as if they were qualified by the words “or thereabouts”. It would also provide GMPTE with a defence in relation to its liability to maintain streets similar to that available to highway authorities under the Highways Act 1980 and would disapply the obligation upon GMPTE under section 28 of the Tramways Act 1870 to maintain and repair streets. A copy of the application, and of all documents submitted with it, may be inspected free of charge between the hours of 9.00 am and 5.30 pm on weekdays at GMPTE’s above-mentioned offices from Wednesday, 8 January 2003 until Wednesday, 19 February 2003. Any objections to, or other representations about, the proposals in the application should be sent to the First Secretary of State, Office of the Deputy Prime Minister, c/o TWA Processing Unit, Zone 3/11, Great Minster House, 76 Marsham Street, London SW1P 4DR on or before 19 February 2003. An objection or representation must (i) be received by the Secretary of State on or before 19 February 2003, (ii) be made in writing, (iii) state the grounds of the objection or representation and (iv) indicate who is making the objection or representation, and (v) give an address to which correspondence relating to the objection or representation may be sent. The Secretary of State may make objections and other representations public and will copy them to the applicant for the Order.
