THE A500 TRUNK ROAD (STOKE PATHFINDER PROJECT) COMPULSORY PURCHASE ORDER (OD NO 64) 2003
Notice is hereby given that the Secretary of State for Transport in exercise of the
powers conferred on him by the above-mentioned Acts has made the Compulsory Purchase
Order, entitled as above, with modifications authorising him to purchase compulsorily:
(a) the land and rights described in the schedule hereto for the purpose of:
(i) the construction of new trunk roads in the City of Stoke on Trent in pursuance
of the A500 Trunk Road (Stoke Pathfinder Project) and Slip Roads Order 2003.
(ii) the construction and improvement of highways and the provision of a new private
means of access to premises in pursuance of the A500 Trunk Road (Stoke Pathfinder
Project) Side Roads Order 2003.
(iii) the diversion of part of the navigable watercourse known as the Trent and Mersey
Canal and the execution of other work on the watercourse in pursuance of the A500
Trunk Road (Stoke Pathfinder Project) Side Roads Order 2003.
(iv) the improvement of the A500 Trunk Road in the City of Stoke on Trent.
(v) the mitigation of any adverse effects which the existence or use of the highways
proposed to be constructed or improved will have on their surroundings and
(vi) use the Secretary of State in connection with such construction and improvement
of highways and the execution of other works mentioned above;
Copies of the made compulsory purchase order and of the plan referred to in it, together
with copies of the above-mentioned Trunk Road Order and Side Roads Order(s) (with
their accompanying plans), have been deposited and may be seen at all reasonable hours
from 3 July 2003 to 14 August 2003 at the Highways Agency, Information Point, Room
AG16b, Romney House, London and at the offices of the Highways Agency, 5 Broadway,
Broad Street, Birmingham B15 1BL, and at Stoke on Trent City Council, PO Box 636,
Department of Environment and Transport, 3rd Floor, Civic Centre, Glebe Street, Stoke
on Trent ST4 1RN; The Public Library, Reference Library, Level D, Bethesda Street,
Hanley, Stoke on Trent ST1 3RS; The Public Library, Reception, London Road, Stoke
on Trent ST4 7QE; Stoke Approach Drop in Centre, Church Street, Stoke on Trent ST4
1BL, where they are open to inspection, free of charge, at all reasonable hours.
The Order as made becomes operative on the date on which this notice is first published:
but a person aggrieved by the Order may, by application to the High Court within 6
weeks from the operative date, question its validity on the grounds:
(i) that the authorisation granted by the Order is not empowered to be granted or
(ii) that their interest have been substantially prejudiced by failure to comply
with any statutory requirement relating to the Order.
