RELEASE AND APPOINTMENT NOTICE

In accordance with the Insolvency Rules 1986, notice is hereby given that pursuant to an Application made by Daniel Robert Whiteley Smith (“Mr Smith”) and the subsequent Order of the High Court dated 3 October 2003 (“the Order”):

Mr Smith has been removed from office as Liquidator of Coronation Marketing Limited (in Compulsory Liquidation) and of those other Companies in Compulsory Liquidation listed in Part 1 below. In respect of those Companies listed in Part 1, section A, Michael John Hore, a Partner in the firm of RSM Robson Rhodes LLP, has been appointed Liquidator in place of Mr Smith. In respect of those Companies listed in Part 1, section B for which Mr Smith was one of two Joint Liquidators, Mr Smith has not been replaced as the matters are well advanced and do not require another joint appointee.

Mr Smith has been removed from office as Liquidator of Cobco (235) Limited (in Creditors’ Voluntary Liquidation) and of those other Companies in Creditors’ Voluntary Liquidation listed in Part 2 below. In respect of those Companies listed in Part 2, section A, Michael John Hore has been appointed Liquidator in place of Mr Smith. In respect of those Companies listed in Part 2, section B, for which Mr Smith was one of two Joint Liquidators, Mr Smith has not been replaced as the matters are well advanced and do not require another joint appointee.

Mr Smith has been removed from office as Joint Liquidator of Berkeley Construction Services Limited (in Members’ Voluntary Liquidation) and of those other Companies in Members’ Voluntary Liquidation listed in Part 3 below. Mr Smith has not been replaced as Liquidator as the matters are well advanced and do not require another joint appointee.

Mr Smith has been removed from office as Joint Supervisor of The Heart Hospital Limited (under Company Voluntary Arrangement) and of those other Companies under Company Voluntary Arrangement listed in Part 4 below. Mr Smith has not been replaced as Supervisor as the matters are well advanced and do not require another joint appointee.

Mr Smith has been removed from office as Administrator of The Green Health Club Limited (in Administration) and of those other Companies in Administration listed in Part 5 below. In respect of those Companies listed in Part 5, section A, Michael John Hore has been appointed Administrator in place of Mr Smith. In respect of those Companies listed in Part 5, section B for which Mr Smith was one of two Joint Administrators, Mr Smith has not been replaced as the matters are well advanced and do not require the appointment of another joint appointee.

Mr Smith has been removed from office as Administrative Receiver of AGF Realisations Limited (in Administrative Receivership) and of those other Companies in Administrative Receivership listed in Part 6 below.

Mr Smith has been removed from office as Trustee in Bankruptcy of the estate of Priscilla Jane Abbott and of those other individuals listed in Part 7 below. Kevin John Hellard, a Partner in the firm of RSM Robson Rhodes LLP, has been appointed Trustee in Bankruptcy of those estates listed in Part 7 in place of Mr Smith.

Mr Smith has been removed from office as Supervisor of the estate of John Edward Hall and of those other individuals listed in Part 8 below. Kevin John Hellard has been appointed Supervisor of those estates listed in Part 8 in place of Mr Smith.

Please Note:

1. Creditors of any estates listed in Parts 1 to 8 below are permitted to apply to vary or discharge the Order provided that such application is made within 28 days of this notice and on substantial grounds.
2. In the case of the estates in bankruptcy or in liquidation where there is a Creditors’ Committee, it is open to the Committee to require Mr Smith to provide an account of his administration for the insolvency, including a summary of receipts and payments, and a statement that he has reconciled his account. Where there is no Committee, a similar request may be made by an individual Creditor, but this will only be complied with if the Creditor applies to the court within 28 days for such an Order and the court grants it. Unless there are good reasons to the contrary, the costs which Mr Smith would incur in complying with any such requirement would be paid as part of the expenses of the individual insolvency.
3. Creditors of any estates in liquidation or in bankruptcy affected by the Order are reminded that they may also call for a statement of receipts and payments under regulations 11 and 25 respectively of the Insolvency Regulations 1994.
