THE KENSINGTON AND CHELSEA (PARKING PLACES (FREE PARKING SUSPENSIONS) (NO 1) ORDER 2004
FREE SUPENSION OF ON-STREET PARKING PLACES IN CERTAIN CIRCUMSTANCES
1. Notice is hereby given that the Council of the Royal Borough of Kensington and Chelsea (hereinafter referred to as “the Council”) on 25 February 2004, made the above-mentioned Order under sections 45, 46, 49 and 124 of, and Part IV of Schedule 9 to, the Road Traffic Regulation Act 1984 as amended by the Local Government Act 1985, the Road Traffic Regulation (Parking) Act 1986 and the Road Traffic Act 1991. 2. The general effect of the Order will be, in respect the Royal Borough Council’s on-street, charged-for, parking scheme, to: Amend all relevant traffic management Orders so as to categorise in those Orders the events where the Council will suspend a parking place, free of charge. Those events are set out in the Schedule to this notice. (N ote: the Royal Borough Council is currently operating this system in respect of certain of these categories, but has now decided to add extra classifications. It is considered necessary to amend the traffic management Orders accordingly to prevent any adverse adjudication decision being made in respect of such a suspension). 3. Copies of the Order which will come into operation on 1 March 2004, and of all other relevant documents can be inspected during normal office hours on Mondays to Fridays inclusive, until the end of a period of 6 weeks from the date the Order was made at, the Town Hall, Hornton Street, London W8 7NX. 4. Any persons desiring to question the validity of the Order or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relvant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Order may, within 6 weeks of the date on which the Order was made, make application for the purpose to the High Court. Highway work undertaken by the Council. 5. Projects wholly or partly funded by the Council. 6. Where parking is required by locally-based charities. 7. To allow for tree pruning in garden squares. 8. To allow Disabled Persons close access to a particular location or address. 9. To allow Disabled Persons a longer period of parking whilst undertaking treatment at one of the medical institutions located in the Royal Borough. 10. To allow for maintenance and/or repair of listed buildings to which the public have access. 25 February 2004.
